Article 21(3) of the Constitution
Quote: All State organs and all public officers have the duty to address the needs of vulnerable groups within society, including women, older members of society, persons with disabilities, children, youth, members of minority or marginalised communities, and members of particular ethnic, religious or cultural communities.
This is a political masterpiece for the indians. Indians are now a minority tribe and will be entitled to affirmative action including governmemt jobs, political appointment and other interests as they may lobby for.
I have no issue in recognizing the Indians as a tribe of Kenya or the benefits they are likely to accrue from their new status.
However, this is not a decision that should be left to the president to make unilaterally.
The people of Kenya (including the common "Patel" indians) have a right of say on who becomes recognised as a Kenyan tribe/community. It should not be left to the President and DP to declare indians a Kenyan tribe after a visit to the temple, eating chapati with indian elite and wearing turbans.
This should have been done with public participation particularly through a motion in parliament.
