Oscar Pistorius murder trial verdict

The judge is currently delivering her verdict.....Premeditated murder unlikely after the Judge questioned the reliability of several witnesses in court.

"However the judge could find him guilty of murder "dolus eventualis" smile if she rules he fired four shots into a tiny cubicle in full knowledge and understanding that somebody irrespective of who was in there, could be killed."


Possible scenarios

Premeditated murder:
Intended and planned to unlawfully kill Reeva Steenkamp, or an intruder......Mandatory life term - 25 years before parole


Common-law murder:
Unlawfully intended to kill in the heat of the moment but without "malice aforethought". Either: Dolus directus (direct intention), shot at door intending to kill Dolus eventualis (aware of likely outcome), knew someone might be killed and still fired gun.......Minimum of 15 years up to 20 years, at judge's discretion

Culpable homicide (manslaughter): No intention to kill. Takes into account disability, but actions negligent and not in keeping with a reasonable person......Maximum of 15 years, possibly between seven and 10 years


Discharging a firearm in public
: Two counts for allegedly firing a gun through a car sunroof and discharging a gun at a restaurant........A fine or up to five years - for each charge


Illegal possession of ammunition:
In possession of .38 bullets for which he has no licence......A fine or up to 15 years

Surely, who else would be in the bathroom of your bedroom during valentines? Before shooting 4 times wouldn't you ask first who's inside? In my opinion, she must have hit below the belt and his low self esteem acted out.

Sad...A girl wakes very early in the morning to shower, make up, thong, nice clothes and heads to the boyfriend's digz.

The man is resting on his bed, dreading the moment the girl will show up. His pistol is ready and corked. This has to be over.....

Pistorius not an "insurmountable challenge" for SA prison system
Courts do not exist for a popularity contest but "solely to dispense justice"
General public may not even know the difference between punishment & vengeance
Nothing I can say or do today can reverse what happened on 14 February 2013.

In determining appropriate sentence, degree of culpability must be considered
The accused's negligence cannot be neglected.
In imposing a sentence, a court must be merciful.
A court should strive to keep such a person 'tragically negligent' out of prison

Lenient sentence might prompt public to take justice
BREAKING: Sentenced for 5 years in jail for culpable homicide and 3 years for discharging firearm; to run concurrently

On the firearms charge, Pistorius gets three years in jail, wholly suspended for five years.

Murder most foul... it is:

South Africa's Supreme Court of Appeal ruled that the lower court did not correctly apply the rule of dolus eventualis - whether Pistorius knew that a death would be a likely result of his actions.
Reading the ruling reached by a panel of five judges, Justice Lorimer Leach said that having armed himself with a high-calibre weapon, Pistorius must have foreseen that whoever was behind the door might die.

...the identity of the person behind the door was irrelevant.
