Donations received from members and well-wishers should not be taxed. But when a church engages in business (e.g., JIAM's matatus, the Catholic's Insurance company, ACK's and PCEA's rental flats, offices and meeting rooms etc), then the income from that business must be taxed.

Assuming that religious organisations are ran by forthright people, then I do not expect there to be any problem with compliance. All that KRA has to do is write to them and they should do the right thing.

But I guess my assumption is probably too much to expect!

Hata hizo donations should be taken as income and taxed.

Tax donations? What is the rationale? Taxing tithes and offerings makes no sense but I agree commercial income should be taxed.

@Laughing out loudly, what would you say about pastors who sell hankies, olive oil, holy water etc and get 'donations' in return. i think this kind of transactions can be categorised as business and taxed

Walipe kodi. Some pastors take the congragetion for a ride especially those with mpesa business numbers. For once KRA is targeting a very and the right sector.

Taxing donations is effectively a case of double-taxation. The person making the donation is doing so from income that has already been taxed...and receives nothing in return for the donation.

However, @vinii is right, if the church sells holy water, then that income is liable for taxation at normal rates. But what would you say about planting seeds for prayers; can KRA argue that the seed is payment for services rendered hence qualifies as business income?

Menawhile its only the other day that Kagame closed down around 6000 churches and 100 mosques in Rwanda and demanded that all pastors/imams must have a degree in religion from an accredited university.

He should have closed all of them. That's the only way to bring a country's collective IQ up.
