How can the Judiciary be complaining while they are the subject matter? Wako and Gicheru who are members of JSC have an interest in the appointments as it is about their jobs and when do they go home. Kibaki has caught them by surprise. It is time to go home guys. We have just stripped MPs the power to decide their own salaries. Why then should we let the Judiciary dictate about what is right and what is wrong on issues to do with their appointments? You should remember the same judges attempted to sabotage the referendum in order to preserve their jobs.

Dude, here we have a constituion that is in operation!!!

I do not disagree that we have a constituition. What if the PM had agreed to the list? Would we be hearing all this noise? JSC are now saying it is their baby, the PM is saying the baby should have been born by the two prinicipals but only one principal got to name it. Who is fooling who here? Either PM is wrong or JSC is wrong. There is an element of insincerity. Am not saying the President consulted. Do not get me wrong.

@mcr, are u really really sure SKM was lying? Its sad how low this forum has sunk. Lots of prejudiced biased opinions of how BAD or good individuals are. Objectivity is out in the wastebin. Even more pitiful is the sorry posts by some WELL RESPECTED mboys here. As of now, there's a near unanimous praise of ICC, Ocampo n RAO. Contrary, AU is the devil while SKM is its advocate, WITHOUT ANY PROPER SUPPORTING MATERIAL. Cmon pipo, we aint mashada. Sio kupayuka tu. Today, RAO alid* point. So did SKM, Adan, Machage, Orengo n of course my favourite Githae. Stop the FALLACIOUS discrediting of personas based on old goofs.

Look at the issue in a very simple way. If UK and WSR lands in the Hague, either RAO or MK(or both) will be implicated. MK is more likely 'culprate'! Don't forget he is gen-KIGWOYA. So we must have deferral\referral to ensure UK succeeds Baks and the general will be safe. Moi will be happy that his project succeeds at last and there will be peace in RValley. RAO will never be nearer state hse than he was on 27-17-2007. All we need is peace.
The appointments were done as PM was moving from Ivory C to Angola. How could he be consolted! Kalonzo should now be planning to handle Kofi.
The opposite of courage is not cowardice, it's conformity.
