Nowadays any crime is bailable including murder. Its upto the prosecution to give any compelling reasons to the judge why you cannot be released on bail. For a traffic offence, being released on bail is the default position. Unless you can't raise the bail.

Two years ago was arrested for worn out tyres and not having my DL. It was early in the morning so was taken to court on the same day. Strangely the magistrate only fined me on the tyres and accepted my story of forgetting my DL in my wife's car.

most guys put their DL's in their cars on the sun visors so when you switch cars you are in trouble. I once switched cars with my bro and as usual he left his DL in his car and mine in my car. when I was stopped hapo Mlolongo i dutifully showed the cop my bro's DL and he inspected it called me by my bro's name and I answered dutifully "Ndio ofisa" and he let me go

While I deplore the driving habits of many Kenyans, I am very unhappy with the way these new rules are being implemented. A colleague of mine has just parted with a K.sh 500 bribe because of a small crack on his windscreen. What is interesting is that instead being issued with a charge ticket the arresting officer insisted on taking him to the police station. He had no option other than to cough the bribe. It seems that implementation of the new rules is turning out to be a great opportunity for our police officers to coerce Kenyans into bribing them.

About the effects of the new rules – up to now, many people in the middle class have been thoroughly harassed by the police. Several of my colleagues have been leaving their vehicles at home afraid to rub the law the wrong way. At my watering hole, numerous patrons that are regulars have not been visiting and the proprietor has been complaining of depressed business. And there are funny conspiracy theories going round. Last week somebody told me that some well-connected individuals are trying to raise campaign money.

@mpobiz, is drinking expired milk healthy? Or better still, is driving with an expired insurance license legal?
Expired means ceased to be valid. And therein lies your answer.

If your licence is expired, you are not supposed to be driving in the first place, you are technically illegally on the wheel. So, you are liable for ANY accident you shall be involved in.
