operation 2012

- no one has the 50+1 so far.

- at this rate, the 2012 polls will definitely head for a run off.

- there is a likelihood that the difference between the 2 candidates in the runoff will be less than 10%.

- this is kenya. an election petition is 100% certain if there is a runoff.

- the CJ will be the head of the Supreme Court and chair of the JSC. will have some influence on the petition verdict.

- each side would want to pull a Gbagbo or a Bush if it comes down to the wire.

A very interesting scenario has been created. It would now be difficult to give other people the job. What do you do with the one nominated? Do you say they are all bad? DOn't they deserve a chance? PNU and ODM were huggling each one wanting one of their own. All name discussed were ignored. If someone tries to push for those names, they will surely look very bad now. Interesting to see what happens next.

Don't be too emotional, don't get carried away, this is Kenyan politics. Don't forget that Kibs has nothing to lose and will be retiring next year. MK does care who takes up those seats, thats why he decided to nominate them in the first place, there is no "political maskirovka" here, it was simply a case of poor advise leading to bad choices, if the list is rejected, then he will have lost a great deal.

The AU endorsement of ICC deferral means very little, he still needs to go past the veto powers of UK, US and France in the security council, what will he trade this time. I doubt the African representatives in the council will be willing to stick their necks out too far to horse trade for the sake of the 6 Kenyans.

I assume the general desire of Kenyans is to see those responsible for PEV headed to the hague so even if he were to succeed, he would lose much more than his 6 beloved victims.

I think RO's failure in Ivory Coast has really hurt his persona internationally. In politics you goof and the wolfs pounce, look at how Kalonzo is smiling after trouncing RO in the continental turf.

How can the Judiciary be complaining while they are the subject matter? Wako and Gicheru who are members of JSC have an interest in the appointments as it is about their jobs and when do they go home. Kibaki has caught them by surprise. It is time to go home guys. We have just stripped MPs the power to decide their own salaries. Why then should we let the Judiciary dictate about what is right and what is wrong on issues to do with their appointments? You should remember the same judges attempted to sabotage the referendum in order to preserve their jobs.

I wonder how Marende will rule on this one, he could just upset RAO or Kibs either way.
