sparkly wrote:
KenolKobil has lost yet another legal battle after a Nairobi judge declined to suspend an interim injunction obtained by a sacked worker stopping the firm’s takeover by Swiss-based Puma Energy. Industrial Court judge Njagi Marete threw out an application filed by the listed oil marketer seeking lift the orders granted to Joseph Kamau Thuo and said the acquisition would remain suspended until the dispute is heard and concluded. http://www.businessdaily.../-/cwo81ez/-/index.html
Employees win the battle but, they will never win the war? There is no court in the world that will force an employer to employ an employee, none, zero. Employees must realise that no employer has a duty to maintain them and their families until retirement, as they drive nice cars and eat in fancy restaurants. Stop living from paycheck to paycheck and rushing to the ATM to check "kama tumelipwa" from 25th to 30th. KK ina wenyewe na itauzwa wapende wasiipende! It all depends on the contract, they aint against the takeover rather they want to be part of PUMA. On the other article, How is Segman going to differentiate KK from KK petroleum? This will be an Uphill task, the case might take ages in court. "There are only two emotions in the market, hope & fear. This transaction is beginning to stink! courtesy of CMA impotency. CMA should have taken charge and prevailed upon government and it's organs to ensure efficiency in progressing this transaction. The commercial and industrial courts will require to be disbanded or restaffed sooner or latter. I believe our current hon. judges in these courts 'wako down' Ki business. You can't sue to stop a transaction since you have been terminated, it's not even a case worth entertaining in court especially if there is a contract. This is a matter to be handled by attornies. Does Joseph expect a wild compensation really? For all we care, KK can keep his case in the same court for years until the poor guy can no longer afford lawyers!
Business matters be they KK or others require quicker dispensation otherwise stalling matters has a massive cost implication and after some point the judgements issued may be useless. For instance the many KK matters in court are being handled very carelessly by the courts. One doesn't have to be a judge or a legal scholar to see this. The handling of the transaction across all government levels has been a very bad advertisement of the capital markets in Kenya and the business attractiveness of Kenya. It's clear if it's not a bank takeover don't bother doing a takeover in Kenya. Either way if Puma opts out because of the too many hurdles, it's the country's loss. Some of the cases are frivolous and in ordinary times would not fly, however since people can smell money, well lets clutch at whatever straws!! I shudder to think what will happen when the firming out of successful oil blocks comes around what will happen, and here the stakes will be very big. You can expect Turkana county will be in court forever demanding a bigger piece of the pie, KRA will probably be there as well. The sooner our commercial and industrial courts get their act together the better....

The great depression..if no statement is coming this week then 12bob prints next week...and the courts are making sure the management doesnt discuss the issue by delaying ruling on an urgent business matter "Don't let the fear of losing be greater than the excitement of winning."
