The lady could also be acquitted of murder. She could argue that she invited a friend to her house, then an argument ensured between them that degenerated into a fight and when the visitor wanted to stab her with a knife, she rushed to the kitchen and grabbed a pressure cooker and hit the attacker on the head in self defense. That she then panicked on how to dispose the body and in a moment of insanity threw the body into a dam. She can only be charged with manslaughter not murder.

My fren, you earn the title of murderer when you put someone in a gunia and order their disposal. Your supu is in for life

Not true @murchr. The method of disposal isn't mentioned as part of the elements of murder as per the law...

Malice a forethought google that. She called the taxi driver early to let him know kuna kazi jioni

Shifting goal posts. The issue under consideration was the packing of the body into the gunia.

About the taxi, that may be true, but so far, we could only be speculating on the reasons for the event.

I think murchr is spot on. My elementary understanding of law tells me that to make a case for murder you need to show only 2 things: Mens rea and actus reus and murchr has just clearly stated the the 2 in his statements above.

The act of planning and later trying to conceal and hide evidence will get her in for murder

Quote:
1st Degree Criminal Homicide (Murder) -- These are acts involving the death of someone in "cold-blood" or by "lying in wait".

They are distinguishable by the MPC mental state of "purposely" which is defined in Homicide Law as having three (3) elements: (a) premeditated -- meaning fixed or obsessed; (b) deliberate -- meaning "cool"; and (c) malicious -- meaning scheming or clever. Also, the crime of felony murder (someone dies during commission of a felony) is automatically 1st degree homicide.

(2nd Degree Criminal Homicide (Murder) -- These are acts involving the death of someone in the "heat of passion". It's basically a catchall category today for acts such as shooting bullets up in the air, but historically, a number of older terms were associated with this grade; terms such as the "year and a day" rule (for when the death had to occur) and the idea of "malice aforethought" (which meant wicked, evil, depraved, spiteful, or with depraved heart). Of these terms, only the phrase "depraved heart murder" is still used. Heat of passion murder doesn't require provocation, but it still requires proof of intent.

I know you tycho is arguing just for the sake of it but we shall see what the IO comes up with.

Also the murder weapon is missing my guess is some kenyan collected it and its probably on sale somewhere that weakens the case but also it depends on how the ODPP will argue it out.

In Trumpland, England and elsewhere, if someone attacks you in your own home you have the right to shoot them in the head and no questions will be asked.

How was wangui supposed to respond when confronted with a knife in her own home?

The castle doctrine is a common law doctrine stating that persons have no duty to retreat in their home, or "castle", and may use reasonable force, including deadly force, to defend their property, person, or another. Outside of the abode, however, a person has a duty to retreat, if possible, before using deadly force.

Castle doctrine and "stand-your-ground" laws are acceptable defenses for people who have been charged with criminal homicide.

Yep. They appear to have been the best of friends. It's perplexing.

“My daughter is incapable of hurting anyone as she was brought up in a Christian way,” Ms Wairimu struggled to explain.

Parents don't know how their children earn a living away from home. Even when they are told what they do, they tend not to believe. They think their children are those innocent village girls/boys they brought up.
