According to the Constitution, such rights can only be given by Parliament.

But then, who cares about the constitution in Kenya?

You are partly right and partly wrong. Article 71 of the Constitution provides as follows:

"71. (1) A transaction is subject to ratification by Parliament if it––
(a) involves the grant of a right or concession by or on behalf of any person, including the national government, to another person for the exploitation of any natural resource of Kenya; and
(b) is entered into on or after the effective date.
(2) Parliament shall enact legislation providing for the classes of
transactions subject to ratification under clause (1).

But Paragraph 8(3) of the Sixth Schedule (Transitional Provisions) provides:

"The provisions of Article 71 shall not take effect until legislation contemplated under that Article is enacted."

So what Kenyans should be demanding for is the urgent enactment of the legislation regarding the transactions that require parliamentary ratification.

YOU ARE ALL WRONG!!
you need to differentiate 3 things
- ownership of land
- ownership of oil
- ownership of the right to prospect (look for oil)
ownership of the right to prospect does not mean that the owner of the same owns the land or the oil - it just means that the owner of the right to prospect is the only one authorized to look for oil in the said parcel of land. ownership of land in kenya does not mean ownership of the minerals therein - NO! this is not the wild west! its moot to even discuss who owns the land since that is immaterial! the minerals will make it public land read 62(f) of the constitution. however the right to look for minerals and mineral oils is up for sale and is licensed by the gava, the said company had been licensed just in block 10BB as Tullow was licensed in other areas. the minerals act allows companies to trade these rights.
