And it helped that he surrendered to the police. Also this is not the first time bail has been granted to a Capital offence suspect under our new Constitution.

there are several ways to look at this
- the constitution does not declare what is bailable or not. the laws and regulations sourced from it do.
- who says the guy is guilty? if he is guilty he should be in prison. there is no need to keep someone in cells just because.
- its all MUTUNGA'S FAULT!

He is guilty, but extenuating circumstances will reduce it to man slaughter and I'm sure the police and magistrate are aware of the facts.
