By CORRESPONDENT, NAIROBI, Kenya, Aug 9 – The sentencing of rugby players Alex Olaba and Frank Wanyama has been postponed to August 16.

Chief Magistrate Martha Mutuku gave the directive on Friday saying the court would retreat to consider extenuating circumstances argued by the two.

Olaba and Wanyama were Thursday found guilty of gang rape having been charged with the offence in April last year after they reportedly raped a female musician at one of one of their residences at Seefar Apartments in Nairobi’s Highrise.

Magistrate Mutuku was urged to consider the two were only aged 23 and 22 years while the complainant is 24.

“As young as they are come from humble backgrounds and it is through their career that they have been able to support their kin,” their lawyer argued adding: “they had not planned to meet the victim on the material day.”

The court had on July 12 issued a warrant of arrest against Mahaga after he failed to appear in court when the ruling had been scheduled to be delivered.

Magistrate Mutuku was ready to deliver her verdict Thursday but the Kenya Harlequin player failed to show up.

This prompted the court to push the verdict to Friday afternoon during which session the prosecution applied for a warrant of arrest after Olaba absconded for the second time.

Olaba and Wanyama were set free on a Sh500,000 cash bail each after denying the charge of gang raping a rugby fan during her birthday party.

The court had directed that the matter be mentioned on August 5 before Magistrate Kennedy Cheruiyot as Mutuku proceeded on her annual leave.

“As young as they are come from humble backgrounds and it is through their career that they have been able to support their kin,” their lawyer argued adding: “they had not planned to meet the victim on the material day.”

This is their plea for a lighter sentence? The victim had not planned to be raped on that day, had she?

They should have thought about their kin and ages if they were that important.

I've been following this case and at some point I was sure it was going to fall off the radar. Now, I'm not that young but the Almighty has been good to me and I could pass for a younger me. Early this year, a group of young men & ladies 20something yr olds added me to their whatsapp group. The things the discuss, memes etc are just shocking especially on Mondays after a weekend, long weekends like this one even worse. I think our values have really changed. These are young people with good entry level jobs, uni graduates most in IT, 3/4 of them raised by single parents or other family members not that well to do. These guys are experimenting with everything and I can see how the line can be blurred between consensual sex and rape in parties after drinking and whatever other things accompany those drinks. I just think our morals have fallen to a super new low and if you have kids, bring them up the old fashioned way with discipline and teaching being key.

That said, if these guys are guilty and it look like they are, I hope they receive the maximum sentence ili iwe funzo. We have too many youth so we should not worry about their replacements in the rugby club, life etc. That was a very weak defence line.

Because of my profession. It's a group of young professions from a certain sector. Maybe one or two people here are in that group judging from some discussions here.
