but it is the early worm that gets caught.

Have you filed your personal tax returns? Any one who's done it online (apart from the commissoner general) to share the experience...

I filed my returns last week and it was really easy and straight forward. I used the online portal instead of using the TSW software, but either may suffice.

The key steps are:

1. You have to be registered online (www.kra.go.ke/portal)
2. Simply login, navigate to file returns option
3. Fill in your employer PIN, your full names, indicate if you will file on behalf of spouse (YES/NO)
4. Navigate to section G (if you have no other income apart from salary) and put your total basic salary (on P9 form)
5. The next section will require you to put the total PAYE deductions for the year
6. If you have a mortgage, investment plan or insurance you will enter the totals deducted for the year(BTW this qualifies you for a refund...LOL)
7. Click on the calculate button at the bottom and the system will either show a negative (you owe KRA) or a positive balance.
8. Finally, check the "I Agree" statement and submit your return.

@Sizzia,
Do you have to upload the P9 form?What of the bank details for a refund(which never happens)?
Does the portal generate a submition report which can be printed as proof of filing the return?

@ Chaka, the P9 form is normally issued by your payroll department. You will only use the figures on the P9 form and not uploading the entire document.

You can view the status of your submission anytime when you log-in and use the link called "Inquire Declaration". It should read accepted.

As for the bank details, you can indicate the desired bank when registering as a taxpayer.

@sizzla, muchas gracias, seems quite straightforward.

Just noticed that most of us are loathe to fill in section G. It is a real mark of character I tell you to introduce all that additional rental income, side quid from taxi business, sale of clothes to friend...

But one thing that has not been clarified is when the new rule will take effect. You see, the Finance BILL is still a BILL until it is passed by the tax dodgers.

So, the previous rule are technically still in force, meaning that everyone must fill their tax returns for year of income 2010.

To be on the safe side, I would urge everyone to fill their returns and get it out of their way. If you find the online system cumbersome, then download the manual forms, fill them and drop them at KRA.

Rentakl income goes to PART C; Side taxi business goes to PART A {business income} and line 51 (PART J)

PART G is actually the place where you fill your employment income.

I am quite care about what the newspapers report. Check the KRA website and you will not find any public notice to the effect that 2010 returns have been done away with. The only notice is the one whose link I have given and it is very carefully drafted so that it doesn't say in BLACK and WHITE that employees are not expected to fill returns for 2010 income.

For that reason, I advise you not just fill the form and drop it at KRA. They have a drop box at the ground floor of the main tower of Times Tower.

BTW: It is was never the responsibility of the employer to fill & file or even to collect the tax forms for employees. Employers who did this were just doing a favour to their employees.

Now how do you do that? Why not simply fill it yourself?

Just one question. How many have been penalised for not making tax returns? And i filed my returns last year, probably misplaced: any evidence to the contrary? ..........

Mukiha KRA placed an advert on the Friday 24th Daily Nation newspaper clarifying that employees whose only source of income is employment do not need to file tax returns. but wait, you probably dont qualify as you received dividends from a few of the listed companies. Strictly speaking, you need to file a tax return declaring this income although no tax is due on it.

Read it again and you will see what I mean by "very carefully drafted so that it doesn't say in BLACK and WHITE that employees are not expected to fill returns for 2010 income"

It says in part: "KRA wishes to notify the public that the ammendment to section 52b(1) of the income tax act concerning the filing returns by employees does not affect the following cases... Employees qualifying under the ammended requirement who wish to file returns may continue doing so..."

Now, that announcement is not clear whether they are talking about 2010 or 2011 year of income.

The top left-hand corner of this ad reads: "Your year 2010 income tax return is due"

KRA is usually clear about requirements and this time round I am wondering why they are beating about the bush. Perhaps they are also not sure what the status is.

Mukiha, I get you point but my interpretation on the 2010 return being due is that it is intended for people in the categories other than people with income from only 1 source of employement.

But I guess this notice is irrelevant for most people in Wazua as they have several sources of income

This is indeed a confusing directive. Now now, I received some small checks for dividends... 200 - 300 bob. Do I also have to declare this? I was so unmoved by the amounts that I dont even have a record of them! That is IF I banked the check!

dividends - deducted at source... And enyewe sometimes they are so small. At times one doesn't even bank them

Withholding tax on dividends is a final tax. It doesn't go into the tax return.

Think about it: you company makes some profit and pay corporate tax on it. Then from the Profit AFTER tax, it pays you some dividend. The tax on this money has already been paid, hasn't it?

People do get refunds.if u have, u should go to 18th floor, there are also people on ground floor where u can make inquiries on the same.
if u think u have a refund on ur 2010 return, u best file it. otherwise hautapewa.
