How do people, sister/ brother take over property before the suspected wife of the deceased is convicted by a court of law? This calls for very many questions...

Quote:
Tob Cohen's sister to take over Sh400 million villa. Tycoon’s family seeks to transfer Wairimu's personal items to Langata women’s prison where the 52-year-old is detained.

can the 400 Million Villa simply be legally signed away to Tob Cohen's sister as per His will as it was Matrimonial property? Methinks Wairimu's daughter who was legally adopted by Tob Cohen stands to gain on the 400 Million Villa (it is on half an acre...is it really worth 400 Million? I mean you can value it at 400 million but will they get a buyer for 400 million?)

Very true. A child should not be disinherited because of the alleged sins of her mother. The couple were married for 29yrs and the daughter knows no other home.

Some reports indicate they got married in 2007.That is 12 years ago.Where does this story of 29years come from?

Why are there no kids?Sorry it's not a good question but then again it would be good to know why Wairish chose not to have pointy kids as we used to call them.

From the stories flying around, its not as straight foward as I thought........bit Wairish remains key suspect. That Muiruri man also needs some probing....

They have been living together since the lady was 22yrs and the guy 42yrs. That's close to 30yrs. The wedding came later. Regarding biological kids, i'd say we cannot comment about their circumstances since such matters are private but what we do know is that they have one adopted daughter. A child is a child since by law an adopted one has equal rights to a biological one.

And yes you are right about that Muiruri fellow, he is talking too much and wailing more than the bereaved. He appears to know alot of finer details about the murder - the why, how and when - and thus he should also be considered as a person of interest.

Who can paste that law of inheritance here? It is not a right, if a will exists, it prevails.

For those still defending Wairimu... she's guilty as hell

Why doesn't the article tell us about Cohens movements on the night of 19/20th? All it says is that he was at Muthaiga golf club at 10pm "drinking and worrying".

If the author is able to trace Karanjas movements and phone signals, CCTV from naivasha to nairobi and back he should do the same for cohen. eg does CCTV at muthaiga club record him leaving, do cameras on lower kabete road capture his cars movements, when did he arrive home, did the askaris at his gate and neighbours' gates see him arrive, was his phone signal captured at his home, did the workers living in the compound see or hear anything etc etc. Also what about the 2 ladies he was allegedly last seen with?

Your estate should pass on to your dependents i.e wife and kids, and they can contest the will if you leave the estate to 'strangers'. Also matrimonial property is owned on a 50/50 basis and therefore one spouse can not claim to pass all matrimonial property to 3rd parties.

Does the law apply whey one partner"murders" the other one like what Wairimu has done?

The children are not to blame if the parents decide to kill each other. Even in the villages I read newspaper reports of wives murdering their husbands and vice versa but the kids are never evicted from the family home or shamba just because one parent is dead and the other one is in jail.

Also one does not loose their property or share of the property just because they have been jailed. The jail term only relates to your crime, not your property.
