Morality vs legality

Legally,TSC does not have to pay the days after the strike was called off.

Morally, TSC needs to pay for better employer-employee relations.

Bottom line: teachers can only be paid out of sympathy. Will this set a precedent?

Sossion loses his KNUT

William Sossion De-registered From Teachers' List

Kenya National Union of Teachers (KNUT) Secretary-General, Wilson Sossion, was confirmed as no longer belonging to the fraternity of teachers, following a High Court ruling on Friday.

The court upheld a decision by the Teachers Service Commission (TSC) TSC’s te delist Sossion as a teacher noting that he was nominated to Parliament to push ODM's agenda.

The decision backed the commission's move to strip the sec-general of all his teaching credentials back on January 15, 2018.

KNUT Secretary General Wilson Sossion
“The commission has decided to terminate your services as a teacher with effect from January 15, 2018. It has been noted that you were nominated as a Member of Parliament yet the Commission has not received your resignation or retirement letter," an excerpt of the initial letter read in part.

Sossion and 9 other senior officials were deemed unfit for office, having actively joined politics.

Under article 77 and 260 of the constitution, state officers are barred from holding any other office that will profit them as employees.


"A full-time State officer shall not participate in any other gainful employment and any appointed State officer shall not hold office in a political party," article 77 of the constitution governed.

Back then, Sossion and the other officials had moved to court, where they got orders temporarily blocking the government from sacking them.

However, the court ruled that the commission was right, thereby erasing the vocal leader from the official teachers' registry.

A teacher is a professional just like a doctor, lawyer, accountant, engineer etc. You cant de-register someone from the professionals list just because they have joined politics. Sossion is still a qualified professional teacher and can practice his trade anywhere in the world.

I thought he was removed from employment of TSC which is a government agency because he joined politics.... Just like it is a requirement for anyone working for government (including parastatals) to resign first before standing for any political office....so the accountants, engineers, etc employed by government also must resign before taking in position in politics.

Do teachers have a professional body where they get certified and registered like lawyers or accountants or engineers?

He is no longer employed as a teacher by GOK (TSC). To be a KNUT union member you need to be employed by the TSC.

TSC is not a professional body. Its a govt commission just like Public Service Commission or Parliamentary Service Commission. Currently he is on Parliamentary Service Commissions payroll.

Govt can only fire him as an employee but it can't deregister him as a teacher.

He is no longer employed as a teacher by GOK (TSC). To be a KNUT union member you need to be employed by the TSC.

Who registered him as a teacher? Who certifies teachers and registers them? Are there minimum qualification requirements for their registration? Is it P1 or S1 or Nursery school teacher?
