44th tribe- Hindu, Indian, Budhist or Asian

smile Now , Now Indians/Hindus/ (Indian Muslims) Indian Budhists etc are Kenyans as far as they are nationalized and prove they have no affiliation and intention to go back to India. But which Indians/Asians are these?

We have so many Indians in Kenya on work Permit and others on their families sponsorship.
Who is really Nationalized here?

Those who were in Kenya before Independence and their immediate descendants.
Visitors are not Nationalized par'see.

The Govt must Identify the number of those Nationalized and not mere call the Hindus as there are some who are muslims, others are Arabs, Budhists and even Christians like Patni and several Goans brought by colonialists as workers.

They must pledge their loyalty to Kenya and stop repatriation of money back to India for safe keeping for their descendants.

It must be noted here that the Asians here are not merely Hindus but a mix of Hindus, Muslims, Budhist, Christians etc and not just from India but Banglandesh, Srilanka, Nepal, etc

First and foremost the status of the citizenship of all people's on kenya is spelt out in chapter 3 of the constitution where reference is made to former constitution and Cap 172 of the immigration Act (now repealed). Any person born in kenya before or on 12.12.1963 became a citizen if by this date one of their parent was born in kenya. The rest is spelt out in naturalisation act of 1968. Further if they weren't conferred citizenship they got a window through the Citizenship and immigration Act 2011 to be registered as dependants of migrants.

surely how can they be a "tribe"? you cannot have "hindus" as a "tribe" coz they are adherents of a certain religion. Sema Asians or give them their local names Gujeratis, Punjabis e.t.c.

Article 21(3) of the Constitution

This is a political masterpiece for the indians. Indians are now a minority tribe and will be entitled to affirmative action including governmemt jobs, political appointment and other interests as they may lobby for.

I have no issue in recognizing the Indians as a tribe of Kenya or the benefits they are likely to accrue from their new status.

However, this is not a decision that should be left to the president to make unilaterally.

The people of Kenya (including the common "Patel" indians) have a right of say on who becomes recognised as a Kenyan tribe/community. It should not be left to the President and DP to declare indians a Kenyan tribe after a visit to the temple, eating chapati with indian elite and wearing turbans.

This should have been done with public participation particularly through a motion in parliament.
