Fellow Kenyans,i really do not understanding your obsession with this particular case,is it because the Tom is white and rich and most of you are not as rich,therefore he deserves to hang''' for an offence that if otherwise had been committed by myself i wouldn't even get a days sentance for it.

Some while a go I gave an example of this watchman who clobbered a pub patrol to death in Dandora,he got off scot free.

Yesterday,according to the press on line from all main dailies in Kenya,there is a story of one Florence Gathoni who killed her Husband of ten years and got only three months sentance by the same Judge. Guess what? nobody here wants to know that story.

If its a matter of race please lets stop it,and if its a matter of land there are equally many other Kenyans who got huge arcarage of land for free by using state machinary and have not been condemned.

fantony (stop with the snark),Do not confuse the law with morality. My posts have been restricted to the law. Justice Apondi had to apply the law and not consider the morality - justice is meant to be blind to everything else.

Do I personally feel that given in the circumstances and given Chomli's prior justice has been served? I do not. In fact I find myself entertaining doubts on the very judgement by Apondi that malice aforethought could not be established as I feel it is not something that can only exist based on time. But my judgement is based on the information I have gotten from the media unfortunately. Justice Apondi had the benefit of hearing the People's case and the accused and he found no basis in them to sustain murder. I and the majority of people here have not gone through the proceedings and judgement so we cannot really fault the judge here.

I would also like to reiterate that the first accusation of killing had no relevance to this particular case. You could ask why but it is rather a long confusing legalise.

I have to say,I am impressed that you seem to be the only lawyer willing to say something.

So from what you have written it seems then that the law does need some serious overhaul. I have to say however,that this trespassing thing does need to change especially given the propensity of Kenyans planting where they have never sown.

I would shoot the guy and think later too.

The guys making noise are the usual suspects who behave like only the rich do evil things.

So as a warning to fantony and co.,if you step on my land,I will surely shoot you! You can go complain about your justice for the rich and poor somewhere else. I know very many people here feel the same as I do.
