Rongai? Kajiado & Corruption?

Hallo Wazuans,
a Masai family wants to sell me 1 acre in Rongai @ 4M, which seems to be the going price. Apparently, they have a huge inherited parcel (tens of acres), with no title but a NUMBER.Title will be issued once my piece gets subdivided. Beacons are on sight. Transaction will be through a lawywer. So far, i only have negative reports about Kajiado lands office.Corruption and corruption.It seems even with utmost due diligence, you can never be sure. Anybody with any experiences or advice?

It's unlikely a lawyer will advice you to buy a piece of land without a title. Presence of 'beacons' does not mean they own the land. If the price they are quoting is the going price for an acre - why can't you buy an acre from a seller with a title?

@Ndaragwa, The land is vast and is in the name of the family. I understood, most huge land owners only go for titles when subdividing...is this true? Of course beacons mean nothing. I have heard about Kajiado, that even if everything went smooth and title was issued, there could still be issues.

@Rapudox, 4.0M is a lot of money and as Ndaragwa says, if that's the price, then go for similar land with a title. Family land can snowball into issues and as an outsider its best to keep off. If they had a mother title and there is either an administrator/trustee of the land that would be easier.

BTW where is that land in Rongai?

I followed land purchase procedure fully with legal charge being held by top commercial bank and im still in a mess in regard to beacons, with now need for survey to find out actual boundaries.. Kajiado is hell on earth. Buyer beware

@Obiero, did u purchase from original buyer? Which area did u buy? I have now found out that the masai family has a title for 15 acres. They want to subdivide and sell me the one acre. But, am weary....I am insisting on them subdividing & getting the title for the one acre. Only after that will i be willing to buy.
It is so very much annoying, that these simple things are so complicated in Kenya. Through this nonsense, many investors are keeping away. I know other diasporan professionals, who have the means...but not the time, heart and energy for real estate issues in Nairobi

@rapudox it was in Milimani area of Kitengela. Purchase was from second buyer, not intial owner.. However, I have made headway with mine after gettin confirmation from lands that my legal charge is valid implyin only that I need to confirm boundaries as per summon dispute

you are so naive @rapudox and with no offence I shoot/ clean you straight had you given me that chance.
But let me give some hints you may live to remember
1. Your lawyer, who is non interested party and neither a custodial of government documents, will whiteness you agreement but won't do due diligence for you. you will loose your moni after paying hefty lawyer fees (not legal fees for heavens shake) and the lawyer will be proud to engage you on the next shocker case that will leave you properly fleeced.
2. A deceased dies testate or intestate(spell check) Plz. ie with will or without one. as you put it, this appears to be without will. so none of the family member owns a piece but they have legally entertain able rights to the property. that's the catch, you do not have any as for now. and they can not transact for the deceased in individual capacity. to be straight you can only transact with an individual in lieu of rights to inheritance that may never be or through the administrator where you follow a pecking order. pecking order means creditors to the deceased take precedence government first, and you may never get a piece after all.
3. A number issued as an individual's rights to land are entered into a register both for demarcation and gathering(hell kama wamerushwa kwa hewa). a number is just that nothing close to physical property until a title is issued. so buying a piece of land by number you are contented to the fact that you have limitations to live with and the seller can fleece you on that fact properly after making their pocket fat.
4. If a title is to be issued, subdivisions has nothing to do with it. it can as well be issued now. Do not buy comforting words. ask them to subdivide and issue titled deed first and know why they can not do it now. if its about inheritance procedures know who is/are the legal estate administrator(s), they can apply to court for leave of court to sell a portion of the estate to enable them administer the deceased property. you interests will be protected final and non perjury. anything else is gentlemen's agreement and you won't like it when gentlemen start reneging on the agreement.
4. beacon is a mark or corner pegs to a land property. they maybe legal, illegal as for the squatters or by trespass. a legal beacon comes with a certificate and can be certified by a lands surveyor through a beacons register. Very few offices bother at all to enforce them since largely only general boundaries exist in our land registries, probably lease title would.
way forward .
indicate interest to buy, do even commit to buy but on materialisation of a future condition that they will deliver at a future date. how much you would advance in that case, as much as I would invest in kq or msc or paka or sameer, or Olympia or orchard(high risk investment). Anyway hii peso sio ya mamayako, ni yako. You may be ready to be legally entertained too and the corrupt land officers may help you get three acres for one.

It is surprising how easily Kenyans get conned. Some basic background checks would uncover most scams, but most people are too lazy to check and just commit money to the fraudsters. Even more unfortunate it is the middle class that fall into the scam predators and not mama mbogas!
