I thought we are talking about a DEAD trespasser and he didnt die of natural course..... thats why we are where we are.... The death aspect is what makes the case complicated and not just the act of trespassing.

May be.... infact,he might even claim compensation from the government for the extra time he spent in prison.. hehehehe

Some deals are like glass. Sometimes it's better to leave them broken than try to hurt yourself putting it back together.

@ Nonfor,i totally agree with you,this guy has been in remand for more than three years,he has already saved time for the offence for which he was ''found gulity'' . If i had shot the same guy in my property at night i would not even have spent a day in remand.

Judicial controversies are not only confined to Kenya. Remember OJ's and Mj's acquittals in the US? As the judge said,sentencing is not scientific but an art,in other words subjective

I have to think that this issue is only hot because of the land problem and the fact that delamere is not a Kenyan native.

I recall while on college fieldwork,we tresspassed into someone's farm with a university prado (and it had blue licence plates). The owner of the property came out with his rifle already corked and we had to (explain in English) that he shouldn't worry because we had inadvertently staryed into the farm. The guy let us go.

When we left we didn't go to a police station. Instead we continued with our work.

I believe the Chomley case is similar only he chose to allegedly shoot a human being,who reportedly was on flight.

Many issues come to fore here. In my opinion the guy should undergo a medical examination to ascertain his mental stability. On TV he appears quite removed and not-normal. Going by the way his parents look at him while gripping each other,this guy could be a nut case and will surely to pump lead into the next tresspasser even if they were running away.

Arguably,it is okay to immobilise or even kill a tresspasser if he/she poses immediate danger to you or your family. But from media reports on the case,Njoya did not present this danger. That other legal circumlocution is what makes Law an ass.

Wendz,if the prosecutor was serious,a manslaughter case would have been brought. Then family lawyer would have been more concerned about a civil suit.

If you wanted an example of how bad our prosecutors are,you need not go further than this case. No wonder many poor people are languishing in our prisons since the DPP's office is inept and comes out with stupid charges and the poor man cannot afford good representation since our lawyers are busy drinking at the latest strip joint.

As you can see,the delamare family is already one step ahead saying that they are willing to assist the deceased family. So my question is exactly what law do Kenyan lawyers study?

What's the point? should the pregnant 'murderer' like you said have gotten more or less.

In most cases unless bribery is involved,the judges pass their verdict based on the strength of the prosecution. Doesn't it make make you wonder why the three suspects arrested over the Kiambaa murders were acquited for lack of evidence?
