Bogs doesn't care! Because everyone will insist they had done the subdivision earlier. I know a group that had done subdivisions (Larger than 40 by 80 but smaller than 50 by 100 - still called them 1/8), allocated plots to members and the members had fully paid. The Bogs crew totally refused to issue titles. The members were called for a meeting and informed of the new development. The land was re-sub divided, fresh reallocation done (in the order in which people had cleared payment) and members required to top up the difference. Those who missed were allocated plots in a different piece of land. That was last year.
So, to answer your question, Bogs and crew will not allow a transfer for a piece less than 50 by 100 (with no title) to go through and will not issue a title for the same.
Anyone who had a piece of land less than 1/8th na akazubaa and never followed up on the title sijui atafanya nini!!! But I suspect if your transfer documents predate the order, you might be sorted. The only problem is that it might open doors to corrupt dealings with people backdating transfer dates left right and center! They already do it with the invented "Special Boards" that are not anchored in law. They actually write the date of the previous board sitting!!
Never count on making a good sale. Have the purchase price be so attractive that even a mediocre sale gives good returns.
