Land Sale Agreement

Location: Republic of Enchantment.
Hello Wazuans,
I am in a dilemma ,i bought land through installments and i started paying for the same on July 2014.The agreement indicated the figure i would pay monthly and i was due to finish paying by end of this year,however the vendor changed things last month.The vendor (a land buying and selling company) sent us a text message indicating that we needed to pay an extra 25k for title and other charges.The land in question is in Machakos County.


On the sale agreement one point is as below.

The Vendor undertakes to facilitate and transfer the said land and avail all the required documents to the purchaser.

From the little experience that i have, title deed processing fees has always been charged separate.

Once transfer is completed, that's when title deed is processed, at its cost. That's what my agent says.

Is there a standard rate for the title deed ?The mode of communication (sms) is what is making me uneasy. Furthermore for the past one year we have been paying to the account indicated on the sale agreement but from the message the vendor sent the account where we will be depositing will change.The new account name is nowhere on the sale agreement.

Relax, it is normal for the buyer to settle title processing fees. You have the option of getting transfer documents and go process the title yourself. I think what you should do is ask the seller to write officially and state how much is title processing fee, how much is stamp duty and how much is search fee. This is to avoid a situation where they later come back and ask for stamp duty seperately and search costs seperately then othet misc. fees seperately.
