interesting comments.. how does a referee repay for loan they have not guaranteed...kwani ni chamaa? but at least there are bits and pieces of useful info in the comments...

At the risk of exposing what I do for a living, let me set out some things straight here;

1. The loan is unsecured so its one loooong shot before the bank can attach any of her personal belongings. Its possible through the courts but the guiding principle is; NEVER THROW GOOD MONEY AFTER BAD MONEY.

2. A referee is not a guarantor so they can't be asked to pay a cent. They can however expect calls from the bank until ur friend clears the loan. Barclays are known to harass a defaulter's spouse and referees (through persistent calls)to a point where they can't take it anymore.

3.CRB adverse listing is a must. She can forget about borrowing in the next 7 years. Sad thing is that even if she clears the loan the listing stays and no bank or MFI will touch her.

4. Once the loan gets into arrears for +60 days, it will be downgraded and provided for as per CBK prudential guidelines.

What about restructuring? Are banks keen on restructuring of personal loans if one can't pay the full instalment?

yes, referees can't be asked to pay since they don't sign anywhere,mark you one of the 2 referees shld be a relative and a work mate...if you loose your job it's advisable for you to write to the bank explaining your circumstances and u can negotiate on how to clear the balance,this way you stay out of the CRB blacklisted names

How do Barclays keep finding my spouse's new employer every time she changes jobs and is late on loan payments? Ba"claws" actually calls through the official line.

for unsecured debt, auctioneers only come in after the debtor is sued;-
There are three different modes of execution- committal to civil jail, attachment of 1/3 salary or attachment of moveable property-this is where auctioneers come in.

The litigation process is very long and takes at-least an year to get to the point of Auction, the debt also needs to be worth the hustle and the bank has established that unwillingness to pay is the reason for default.

Just tell her to explain to them her situation and request them to stop interest on that basis and give her some time for situation to improve,

On the crb issue the name remains there for 5 years but as long as you've cleared it has no consequence, people default for various reasons like in her case its reasons beyond her control and remember banks are in competition. The last time i checked only stanch-art had an issue with your name being in crb and you had to wait 6 months after clearance to apply for a facility

Well I guess if you PAYE is payed .. that's a given. individual PIN remains the same and thus a little work can identify the new employer ....

nice explanation, now if one were to be jailed for that, is the debt written off, ama after being released you still have to pay.

your only jailed if the bank has established you have family that can bail you out, if you can proove to the court that you totally lack capability..the court has no business holding you any longer...the next step is writing down ..but you remain listed with crb
