4. Guiding principles
The national government and county governments shall be guided by the following principles in the management and administration of agricultural land—
(a) has a communal function and land ownership has a social responsibility;
(b) land owners and lessees of agricultural land, being stewards, have the obligation to cultivate the lands they own or lease and make the land economically productive on a sustainable and environmentally friendly manner;
(c) subject to Article 40(3) of the Constitution, the State may acquire land for public purpose or in the public interest;
(d) pursuant to Article 66 of the Constitution, the State may regulate use of any land in the interest of public order, public morality, public health or land use planning.

The delay in "freeing" the agricultural sector is one of the major failures in Jubilee. Given that the President ni mtu wa mifugo, and he told us he started by "delivering vegetables to the airport in a pick-up". In the constitution in culture section and freedom section, the same issue of "cartels" controlling agricultural produce such as coffee is discussed, the constitution goes as far a freeing weed marketers to mayuu as long as the weed is sold in "traditional African" context and use(priests and intellectual class), this would really assist many wazuans and jobless corner idlers as they would be on the next flight to market the best traditional Kenyan weed worldwide. I get this feeling there is bound to be a reshuffle putting Agriculture directly under Uhunye circa devolution CS style if we are to get anything going in Agriculture.

Objects and purposes of the Act

The objective of this Act is to accelerate the growth and development of agriculture in general, enhance productivity and incomes of farmers and the rural population, improve investment climate and efficiency of agribusiness and develop agricultural crops as export crops that will augment the foreign exchange earnings of the country, through promotion of the production, processing, marketing, and distribution of crops in suitable areas of the country and in particular to—
(a)

circumvent unnecessary regulatory bureaucracy in the crops subsector;
(b)

reduce unnecessary levies, taxes or other barriers to free movement of crop products and provide for a rationalized taxation system;
(c)

reduce unnecessary regulation or over-regulation of the crops subsector;
(d)

reduce duplication and overlap of functions among institutions involved in the regulation of crop agriculture;
(e)

promote competitiveness in the crops subsector and to develop diversified crop products and market outlets; and
(f)

attract and promote private investment in crop agriculture.
