Plot yangu nairobi grabbed

I have a plot somewhere in Nairobi maybe 40 km from town.The area is stil very undeveloped with few houses coming up now.sitima imekuja this year pia and there sre no roads.I bought it a while ago lik 6years n have been checking it once in a while.After an year of not visiting the area,I have found a small house constructed on it and it has also been fenced.When I asked around who built it the few neighbours didnt give me the identity of the person.
By law the guy has literally taken possession of my land and possession is 9 point of law.The plot is on a certificate from the company I bought it from.
Now my question to dear wazuans is how do I go about this and I dont wonna go to court with a house on my plot and the plot do not have a titledeed but certificate.I believe in ruthlessness when it comes to defending my property coz all of it is acquired through sweat.

Maybe the person also bought it "legitimately" and has a certificate!

Thats exactly the option you have get @Mawinder to get you a small gang to go and demolish the house...I said it on a previous thread always do a sale agreement that will dictate when you are supposed to get the deed to the land once final payment has been made...hizi story za certificate and allotment letter I have never been a fan of them no matter how good the land is its so easy to be ripped off...

I have checked with the company that sold and have not issued another certificate.See my point is I have been having the damn plot since six years ago and I was there during demarcation.Infact the neighbours are surprised.So I want a way to 'reset the system' so that when am taken to court,we will be talking of a vacant piece of land.Not a possessed(built land)piece of land that belongs to me!!I want something that will shock everyone in the neighbourhood, am talking of SHOCK ACTION aka SCORCHED EARTH POLICY.That way,I will send a loud message that the land is a no go zone and will not have to be worried about it again.

Why dont you have a title deed 6 years down the line...

Dude...40km from nairobi town and you say that is nairobi? Thika is 45km from nairobi... reduce the quantities and concentration of what you taking!

@Maka there is no justification about that but the company has frustrated me by promising next month everytime I ask for it.Look,these companies make alot of money thru transfers.e.g if I sell u the plot now u pay thyem 30k to get a new cert.Thats why I no longer buy land without title deeds, and normally process them myself.I trust no one in this country
