I think the courts explained clearly that the CCK had no mandate to give tenders. Maybe you didn't want to read that part of the ruling.

since cck has no mandate to give tenders, does that mean all the tenders they have given are void.

I agree with above.

What I'm against is a gov't agency forcing everyone to get the set boxes. Then by licensing certain well connected companies creating a monopoly for these foreign companies.

What they should do is move on to digital if they have to but also provide either multivendor setup boxes for everyone. But creating a market for certain companies is not the work of gov't. It's that simple.

Otherwise we shall all be told to wear our hair like the North Koreans are being told and use only that barber on wazua who charges 5k per hair cut.

Couldn't have put it any better. Would love to see that enforced.

Baba was right that what we have is a "korti bandia". Only a korti bandia would make such a senseless ruling. How do you cancel the license of a company that competed against local media houses and won an open tender?

Funny that I agree with the courts here. Assuming you need the set box to give free to air content. Then the conclusion should be that the set boxes should either automatically go with a tv licence or be considered as an electronic device like the tv and sold from any licenced trader.

By giving one company the exclusive right to sell the set boxes, CCK illegally took away the licenses of the current broadcasters by creating a barrier to their ability to air their content.

Good ruling in my opinion.

No one gave star times exclusive rights to sell set top boxes. There are many other companies (about 50) selling different brands of free to air set top boxes out there in the market eg jolini, Next, samsutech etc. Even star times sells free to air set top boxes, but has a special pay as you watch box that has extra content (like go-tv). There are even digital ready TVs on the market that don't need the boxes. Why should star times be 'punished' for carrying out a good marketing campaign for it's products while the other 50 companies are asleep?

And what happens to Signet that has also been carrying the digital signal? Is their license also canceled like for star times?

Sep 30 will soon be here with us and we will still have to migrate, and there will be a last minute mad rush for the boxes.

"the ruling further set the stage for the disbandment of cck as it was not the independent body contemplated by the constitution"

what are the implications in relation to the other functions of cck.

.......From Jolini......
A number of orders were issued by the three judge bench and we would like to inform our customers the following:
• Jolini set top boxes are universal free to air in nature and as such, they are capable of receiving all free to air TV channels irrespective the providers.
• Signet will continue to provide/distribute digital TV signals and consequently, your viewership will not be affected at all.
• The court ordered that Citizen, NTV and KTN be issued with the digital broadcast license. Once granted the license and begin their signal distribution, you will not need to buy another set top box since Jolini will receive the new signals – after a simple scan.
We continue to offer you our support as you enjoy the digital TV platform using your Jolini decoder. Our shops/distributor outlets remain open.
Jolini remains your preferred digital migration partner.

What makes those 3 TV companies soooo special? Don't other Tv companies eg KBC, K24, Kiss, Family, EATV, Unjiri, Kass etc (and future companies) also deserve licenses? Why should the judiciary treat the 3 companies as more special than others?
