Hi people,I need some enlightnemt here. I have two friends outside the country who have had babies but have been denied Kenyan passports reason being the fathers of the kids are not kenyan although the women are not married. One of them gave the name of the father of the child in the birth certificate but the man is not Kenyan. when applying for the passport stated she stated she is not living with the man. The Kenya embassy told her the baby can only apply a passport in the fathers country even if they are not living together..... The other lady left the part of the name of the kids father as nil in the bcert she was also denied passport. Reason, there is no way a child does not have a father. They want to bring the babies home but cant. The country where the live only gives residence to babies born there but not citizenship. What should they do.

The last time I checked children are only recognised as kenyan citizen if their father is kenyan.

You cannot be a kenyan on the basis of the mother if your father is an alien/ aint a kenyan.

Selah,

I dont think so,a child born by a kenyan girl in kenya qualifies to be a kenyan!!!!!

@ selah

come on...

a child automatically becomes a kenyan citizen by birth or naturalization....

In the current Constitution,if you are born outside Kenya and your dad is not Kenyan, you are not Kenyan. Makes little sense, coz it is just discriminating on women. Best thing to do,wait for the new constitution where this issue will be resolved.

Selah,

WRONG,but you are right.See,the current constitution says if a child's father in not kenyan, the kid is not a Kenyan. But then in a country where impunity reigns supreme, who cares what the law says ? I'm a former Kenyan, but my kid who was born after I had 'changed' citizenship is a Kenyan. How do they (at Nyayo HSE) know that I'm not a Kenyan ??? In the real sense I'm a kenyan not by birth but by impunity !!! And so is my kid......he,he,he...

what I was trying to say,is,if u get a kid out of the country and the father is not a

kenyan,The kid will not be recognised in the current constitution as a kenyan.

But u as the mother will be recognised. But if the father is kenyan while the mother is foreign then the kid will be recognised as a kenyan automatically, just like Obama.

This law applies a double standard which I hope will be rectified by a new constitution.

Ask them to visit the registration department equivalent in the country they are coming from (hoping babies were born there) and get temporary travel docs for the babies identifying them as the parents of the babies. Then let them sort the passport issues here in Kenya through swearing affidavits, visiting chiefs, greasing palms etc
