we need to get to a point where we obey laws bwana - even if they are bad!! politicians should change laws if the laws are bad. we cannot go around subjectively applying court orders. its a very very very bad precedence. courts are the final arbitrator!!

The standoff between senators and governors has ballooned into a constitutional crisis, setting up the National Assembly against the Judiciary. The supremacy contest also saw the Senate threaten to unleash a secret weapon buried in Article 192 of the Constitution, which would lead to closure of affected County governments and fresh elections of governors’ replacements in 90 days. In a bid to further subdue the governors, deemed exhibitionists, extravagant and corrupt, the Senate also deferred discussions on key Finance Bills, thereby holting movement of cash to County governments. Then the Senate also threatened to forward the names of governors who defy summons to appear before its members to the Director of Public Prosecutions on the grounds that they have gone against the law and should be charged. The relations between the two constitutional institutions soared in the day when the Kerugoya High Court lifted the sacking of embattled Embu Governor Martin Wambora, despite Senate’s own vote last week to send him home. Wambora’s fate had been deemed sealed by Senate when it rubberstamped the decision of his own County Assembly. The latest tussle was added fire by the refusal of the Council of Governors to allow nine of its members summoned by the Senate to honour the writs. The courts issued two rulings that dealt the Senate the blow; prompting Senators to devise a three-pronged retaliation against governors and drew the National Assembly into the row. The Kerugoya court suspended the official notification of Wambora’s impeachment, effectively reinstating him to office hours after judges in Nairobi had suspended the summonses issued to the nine governors by the Senate.

How relevant is a court order sending a thief back to the station? A thief that has been caught by his own representatives, by senate and confirmed by parliament as a thief. In any case senate can stop funds flowing to the affected county, so what is the point of the court order, courts should learn to appreciate when they are in a loose, loose situation, CJ should simply call this case to a halt and throw it out, the Justice system is clearly being abused.
