Yesterday I went for a hearing in a court case where am the accused person, my lawyer was unwell so he instructed me to be there early enough. Went and sat in the court but my file was never read, then we were asked if there is anyone whose case has not been read, nearly all guys with transport cases were up simply because the lady who is supposed to give the files never came to work. We were asked to go to registry and ask for the files, all guys got there files except me, we looked everywhere to no avail. I was asked to come next day (today) due to the nature of my work I sent the Wakili and he said isorait he will work it out. To his amusement when he went to the courts he found the file and incidentally there was a warrant of arrest issued already yesterday, but the file was missing yesterday. How possible is this....Hii ni mademoni kweli. Hope i will not nyoroshwa ndani juu ya inefficiency ya court and their cofusion. Lawyers in the house what am I supposed to do if the warrant of arrest is not lifted, as the magistrate is already playing hardballs

not a lawyer but with law basics. You may have to file a case to contest the warrant by first asking court to keep the leash on the warrant executioners until the application is determined. nut this is playing hardballs with a magistrate who is also playing hardballs. the easy way is to simply pray before the same magistrate that the warrant be lifted since you cooperate with the court with no prior infractions. Good luck traffic cases unless involving death are minor as for magistrates as there is always bigger fish to fry like the tax evaders at bandari

Very simple. The file will be called out in your presence and the advocate will apply for the warrants to be lifted explaining that you were in Court. 9 times out of 10 the warrants will be lifted. This is by the way a very common occurence in Criminal Court.
