Hello Wazuans,
I bought a piece of land last year in coast. I paid full amount and signed an agreement that I had checked by a lawyer friend. The seller was to deliver the title to me in 2 months. Of course this never happened and now its two years since I paid the full amount.
The seller is a well known business man in Nairobi and Mombasa. He has been returning my calls and always keeps asking for more time. He attributes the delay is to new processes at the lands office.
I feel I have waited long enough. I have not received a single paper to show that I own the piece of land.
My questions are:
1. What are the costs/implications of taking the matter before a court? What is the best way to file the case.
2. Do you know of any lawyers that are effective in resolution of land cases, yet affordable?

there is no lawyer that is affordable. You can still go to the lands office and find the real status of the title deed.

@incognito, as a precautionary measure, place a caveat on the land so no further transaction can take place. If possible, erect some simple structure on the land and get someone to live there to show some possession/occupancym.

Thanks Gathige. How do i go about placing a caveat on the land?

It took me over 4 years to get my title in Kilifi, having paid half the sum agreed for a one acre. At some point, I gave up and decided to settle for half an acre.

5 years down the line, land price is over ten times the initial price. Just ensure you have a legal agreement drafted by a lawyer and signed in the presence of witnesses. That should suffice. In coast things are done slooowwwlllyyy!
