We should have a 'no-fault' (is that what its called?) divorce in Kenyan law, ...if two people can't stand each other and go ahead to file for the marriage to be ended, I dont see the point of the law requiring extensive proof of who did what to who, why and when.

Does a 'no fault' divorce imply a 'no reason' marriage? Or is it that the marriage had a reason but somehow the parties involved come to realize that the marriage in itself, can't supply their objectives?

The law's only concern is that two people have mutually consented to divorce - the why - actually, everything else is irrelevant. It does seem like a trivialization of the institute of marriage, but the law itself has no dog in this fight - it can't prevent marriages from going bad, and it doesn't make bad unions better by requiring tall proofs and long procedures, it was scarcely involved when two people joined up, not involved either when it all unravels. Essentially, marriage is a contract of sorts between two people, similar in many ways to normal business contracts. The law has awarded itself powers to terminate this, even when some marriages are done under auspicies of religion and thus deemed holy covenants, just with a caveat of a long, drawn out procedure. It is an unnecessary intrusion. The law does not fuss about when two business parties consent to mutually dissolve a contract and it should be the same in a marriage. This deterrence thing is really pointless and just hurts people.
