Ali Gitonga- innocent or guilty? Be the Judge

He is one of the suspects being held in connection with the attack.
He has refused to record a statement with the police.
He is accused of being a member of the Al Shabaab and was part of the terror attack,
He is a recent convert of Islam,
He took his boss's two kids to Westgate on the material day,
He was shot three times,
His head was covered with a jacket as he was being helped out of the mall after being shot,
He swears he is innocent as does the wife,
He is said to have been in Somalia training with the Shabaab then came back to Kenya when KDF entered Somalia,
Is he guilty or innocent?

He says the vehicle he drove to the mall is still there, Claims he does not own a passport and has never left the country, Wife says he has never travelled anywhere, On being shot, he called the wife and told her he has been shot and may die

Is he guilty or innocent? @Shak,First questions first, where did you get the above info? How credible is the info? Any personal connection with the said guy? Justice is NOT to be found in a public forum. To me, he is a suspect until proven guilty.
