Officers at Immigratin are reportedly relactant to issue the pathologist with a work permit citing direction from above.

Is he coming to work or only conduct a single post mortem procedure...work permits differ and legally speaking they are issued for a minimum of 2 ears with the employer applying on behalf of the employee...it is a clear misconstruction to allege that the doctor must have a work permit yet he isnt even seeking employment here.Next itasemekana that lecturer's who come to issue guest lectures must apply for work permits as well,guest athletes the list will be endless where will we draw the line??

it depends on what the guy wrote on his immigration form "Reason for travel"... yeye ndio alijifunga.... for me... I work/consult in Africa and Asia but i was initiated when I once proudly wrote 'to work for xxxy' on that section while submitting my form to the embassy. i got my 3 months visa after 2 months. International travel requires wisdom.... no one refuses entry for a business man or tourists especially if they have visas on entry.

UK guys get their visas at the port of entry....there are different categories of visas...tourist,education,work,investor etc..
My problem is the use of work permit yet he was not comming to work per se...the special passes are available but I'm not convinced because UK residents and indeed commonwealth brethren except India and Pakistan,Malaysia...get their visas when they reach Kenya...hakuna cha application anywhere.

my take.. usually when one vomits, they take water to clean their mouth of the sour taste. is there any evidence marehemu left the room to go and take some water? also one would take time to feel better rather than go back to sleep

it all depends on what he wrote.... even members of the limited commonwealth are not admitted bila questions it all depends on what they say they are here to do.

But, after the postmortem is done, will it be admissible in a Kenyan court of law? For a portmortem done by a foreign doctor in Kenya, how will they prove the circumstances that led to the autopsy being done by a doctor not registered by the MPDB? A doctor of the experience and integrity to perform and report the autopsy could not be found in Kenya?

I think the same rules as for lawyers apply.

We call foreign experts to adduce evidence all the time. And it is illogical to assume that for a doctor he must have passed by MDPB. The applicable rules of evidence are to be found in the Evidence ACT. The General restriction on admissibility of Evidence is at Section 5 of that Act. The only admissible evidence is the evidence of the existence or non existence of a fact that is relevant. Under Section 48 when the court has to form an opinion on a point of science such as this that opinion is admissible if made by a person specially skilled in such foreign law or science. Nowhere does it say that person has to be registered to practise or even approved to practise in Kenya.
