Safaricom loses first round of M-Shwari row with Faulu - http://www.businessdaily...2/-/hbrfyw/-/index.html KE courts are interesting this year. Btw since Faulu didn't patent this idea that they claim was theirs, what is the case? So far the NDA alone can't win this case! Me thinks this is just a Kopa Chapaa awareness stunt. By refusing to refer the case to the Industrial Tribunal, the judge is saying there is no "industrial dispute", which works in Safaricom's favor. In the next para, the judge has refused to injunct safaricom from operating Mshwari, meaning faulu is not suffering any legal loss by mshwari's continued operation. This is clearly a win for safaricom. Safaricom will win this case, plus costs. Else Faulu will win the case but get nominal damages like sh 5. Life is short. Live passionately.

It doesn't matter.They got to the market first and branded it well.That will stick in the minds of consumers no matter what happens to the court case. Uncertainty is certain.Let go

This M-Shwari case is such an example...
I still view this as marketing stunt (Kopa Chapaa) from the poor case representation by the plaintiff. They need to go back to the drawing board and learn how to draft industrial lawsuits.$15/barrel oil... The commodities lehman moment arrives as well as Sovereign debt volcano!

Frankly I never expected Mpesa bank to hit above 5/- in 2012. Today it hit a high of 5.45 with mean supply. This counter may stretch up to 5.80/- at which level I'll cash out 50% and pack that cash for another opportunity. Above 5/- this counter is overextended and I don't see the support for it unless PBT can print above 22B come May 2013 with a div hike to 25cts. If this is achieved, the 6/- handle will be vaulted. $15/barrel oil... The commodities lehman moment arrives as well as Sovereign debt volcano!
