Title Deed Cost

Wazuana Land Guru,

What is the estimated total cost of transfering land from someone who has share certificate to a title deed if one buys that kind of land?

That is a bit tricky coz the vendor will not surrender the original Title deed of the land before subdivision coz he/she does not have one. The titles are usually processed through the original owner/holder thus you may need to liaise with those who issued the certificates.

i have seen the title from the original owner and verified the details at ministry of lands,now from there wot next?

This land must have been subdivided into smaller plots. You cannot process title deed for only one plot coz you need to surrender the original title(Not copy) to the lands office. The ministry of lands does not recognize your share certificate coz it does not exist in their registry. You need to surrender the original title and inform the lands office of the subdivision for the new titles to come out.

When transferring land, you need to surrender the existing original title to the lands office, transfer documents etc. If you buy land from someone, he/she gives you the title deed and signs transfer docs which you take to the lands office so that the land can be transferred to your name, the old title discarded and new title processed in your name. Was the original land subdivided into smaller plots?, if so, all the new pieces need title deeds thus the owner cannot give you the original title deed coz he you did not buy the entire land but a piece of the original land.

Without the original title deed, you will not be able to process a new one. Ministry of land does not recognize your certificate. The costs involved in a normal transfer are as below:
1)Valuation costs
2)Stamp duty @ 2% of sale value for freehold and 4% for leasehold
3)Legal fees if you are using a lawyer/broker
4)Miscellaneous costs which are minimal

Allow me to jump on your post and ask the pros or any surveyors what the average cost is for subdividing land in kiserian to 1/8 plots.Land is about 3 acres.thanks cheers

Around 12k to 15k per plot. I can hook u up with a nice surveyor. Give your email if interested.

1.subdivide the land and
2.process individual titles

basically if the original title is 100acres and you want 1 acre. the owner will subdivide/process 2 titles( in his name) 99 and 1 then transfer of the 1 to you

True. I had land in Ngong and was surprised at the casualness of asking and taking bribes... and this was way back.

You do not have to process all the titles at the same time, however the registered owner must surrender the original title to the lands office and present the subdivision details also. Is the owner willing to surrender the original title?. You must be careful when buying these certificate plots coz the title deed processing may take a long time and you have not control over the process. Ask the registered owner to process the title for you.

OCC (OlKejuado County Council, Ministry of Lands Kajiado & Survey Kajiado was i believe the most corrupt in the country but of late last year the CID, Anti Corruption have moved in and kume nyooka kiasi!
