In this instance, i agree with them, the jail terms are unwarranted for anything less than vehicular homicide under the influence of alcohol. Financial penalties are ok. Where were they when the thing was going through the three readings in parliament. In as much as i agree with them that the fines are high and it will lead to mega corruption i also am of the view that in the end it will bring sanity to our roads. traffic cops will be multi-millionaires by the end of december. 500k fine for drunk driving. i can see them waiting for walevi's outside tamasha and westy on sato night. taxi operators are a happy lot

@maka, hapo umenena. It is shameful that an activist nation like Kenya did not know about the law before Kibaki assented to it. Goes a long way in showing how political we are. Too busy discussing vitendawili and ICC to care about the new law that directly affects us.

It is the law, follow it and be safe. We cannot have a lawless a state and live peacefully. Like a case in Likoni, Watiti farm, where thugs in the name of squatters demonstrate after unlawfully settling on someone's property, it is unacceptable, and the law must be followed. so don't drink and drive, don't overlap, dont over-speed dont jump traffic light and life will be easy. Actually the issue here is not the amended rules or the fines,the problem is the police officers are not in their right state of mind and they will just storm out their offices and charge you for an offence you have not committed so it will either be the TKK he demands or the hefty fine,and by the time you get to the station you will have committed multiple offences.........his word against yours,so be the judge on who the looser will be

If I am sure that I will find justice in Court, then I can fight the corruption. As it is, the system effectively encourages corruption..Case in point, a cop wants to arrest( be bribed) by a mat driver, as passengers, you ask to be dropped in town. Cop enters mat and orders the driver to the station. Before you know it, you are all under arrest for not wearing seat belts!!!no one checked by the way! You imagine you can tell the magistrate your story...you are dead wrong, even the arresting officer does not show up so you 'kataa' are charged a hefty bond and told to come next month.. cop never shows up, magistrate does jerk about it and gives another date.. effectively you get tired or get caught up one day and you don't show up on time,,and PAP!!! Forfeit cash bail and warrant of arrest issued.. You are now a fugitive..... bruury useless system!!!! I Think Therefore I Am

[/quote] The amount of bail the court orders one to pay is usually an amount equivalent to the fine one pays if found guilty or even higher.

If all these passengers decide to fight the charges and all give testimony in support of their respective defences it will be the words of fourteen people or more against the word of a single policeman. The policeman would lose. Then all those acquitted sue the policeman and AG for wrongful arrest etc. The above would mostly not happen because people would find it easy to pay a fine of say 1k and move on.
