Ever heard of a Mareva Injunction?,its a type of court order whiuch freezes assets so the the defendant does not cart away their assests beyond a courts jurisdiction in order to frustrate a judgement...it is indeed funny am not saying he is guilty so dont get me wrong but we have seen such examples people still from corporates,then when things get too hot they resign before you know it they are into politics where because of the truckload of money we worship them,kneel before them etc they win a particular seat then start stealing from you again thats when we start coining names like mpig etc yet he or she dint start the thieving when you elected them it started way back am also surprised some people are supporting him and whatever he purpotedly did...ngojeni koti iamuue and airtel has also a right to take people to court.

Then there is the issue of witness statements. then the production of records and the correct authors of the same records. and there must have been procedure lapse at either de member or wahindi - somebody other than himself who should have arreasted this problem kitambo sana. i am telling you from the know!

After all witnesses are through and he is put on his own defence, he will go and talk to the best lawyer of the case, the magistrate so that they can expoit loopholes in the prosecution case.


Ditto, nothing happens. These are not like those GoK corruption cases with national interest and hype!

Wahinya will be rooming the streets of Nai a free man by 2014!

FYI I started doing what I do in Jan 2010 and I have 5 fraud convictions under my belt and 3 ongoing cases that should lead to conviction.

I don’t think it frustration… is about bad publicity that exposes their weak systems. Most companies absorb the losses but learn!! Is it really worth it for a company like Airtel to go into court battles that will last years over 25M loss? They are making much higher losses anyway!!

Too bad for the guy his assets can be identified, Airtel will go for broke. He will spend a lot on lawyers to drag the case but first he has to get the courts to unfreeze his assets. I guess given his young age and the desire to impress that comes with the naivete of the age he registered things in his name.

With fraud, the amount stolen is usually higher that the amount that ends up in the charge sheets because companies opt to push for prosecution for amounts that they can easily prove as stolen.

The rule is simple, if you dont catch them early, prepare for disaster. 25m looks like small change but its not. The guy probably stole 100m plus.

Is it worth risking your reputation, yes it is. There are probably others within Airtel who are stealing but will be stopped by the publicity that the company engaged in.

Is it worth killing a mosquito with hammer? Yes.

Could the case delay in the courts so long that Airtel will decide to drop it? Yes but the accused will have spent most of his proceeds from the crime paying lawyers. In fact I know that there are cases in which the company's strategy is not to win but to make sure that the thief does not benefit from the proceeds of the crime. Once your lawyer gets wind of how much you stole, you are in for hefty legal fees. That is every defrauded company's dream!

Poor wahinya, was greedy even in the registration of his companies.

Anyway, net, thieves are still way ahead especially in the financial sector and they will get away with it as long as brilliant graduates working for such institutions are paid peanuts - 20-40k and worked like donkeys while still trying to live like the UMKs.

my rule for participating in any fraud are two; know that the fraud wont go on forever (which is most peoples mistake) and out of the proceeds, reserve some money for battles ahead.
