Thursday Nation.

She asked the court to compel her husband to give her conjugal rights at least once a week so that she can have kids with her husband as her faith does not allow her to have intimacy with any other man.

*sperm donor impregnates a woman who may not his sexual partner.
*In IVF) an egg is fertilised by sperm outside the body:

Are the married sperm donors and recipients adulterous?

In IVR if the the doctors will normally use the couple's egg and sperm so there is no issue of adulterly.

But If the man is completely infertile and they decide to go for a donor thats just a medical procedure that cannot be grounds for adulterly.

Definition of Adultery: Voluntary sexual intercourse between a married person and someone other than his or her lawful spouse.

There you have it. Married sperm donors and recipients are NOT adulterous. But!!!! If you do it without involving your spouse... Unaweza kuona cha mtema kuni!!!

Adultery starts in the mind. This is why Jesus said a lustful look is adultery. But IMHO, IVF does not amount to adultery as there is no lust or intercourse involved.

Can the woman recipient claim maintenance fee in the region of 250 million in future?
Where does the law put the donor-man?

A woman had sued her husband who is separated from her for conjugal rights. The woman claimed she bought her husband a car and since that time he had deserted her and was enjoying the company of other women. She asked the court to compel her husband to give her conjugal rights at least once a week so that she can have kids with her husband as her faith does not allow her to have intimacy with any other man.

If this woman chooses to conceive through donor (she desperately needs a child but with no intercourse involved) will he accuse her of adultery?? Seeing he has refused to play his role.
What options does she have?

Mara hiyo hiyo!!!

The law puts the responsibility of raising the kid on both the father and the mother. It is blind on how the kid was conceived! We need a separate law to protect the donor which I believe does not exist in Kenya. I stand to be collected though.

Donors are protected by anonymity in my opinion. If you make such an arrangement with someone known to you, then I believe you will be setting yourself up!

I don't think so, but you can be sure that will be the end of the marriage - legally or otherwise!
