you need to differentiate 3 things
- ownership of land
- ownership of oil
- ownership of the right to prospect (look for oil)
ownership of the right to prospect does not mean that the owner of the same owns the land or the oil - it just means that the owner of the right to prospect is the only one authorized to look for oil in the said parcel of land. ownership of land in kenya does not mean ownership of the minerals therein - NO! this is not the wild west! its moot to even discuss who owns the land since that is immaterial! the minerals will make it public land read 62(f) of the constitution. however the right to look for minerals and mineral oils is up for sale and is licensed by the gava, the said company had been licensed just in block 10BB as Tullow was licensed in other areas. the minerals act allows companies to trade these rights.

Masukuma, I think I am right.

See what is being said of Kenya here.

People in other lands are already thinking we will not be any better.

Wow, just read the ruling on this case.

In short if you were sinking boreholes looking for water and stumbled across some crude oil, don't bother to bring it to the attention of the government because you will not even get a finder's fee!

Maybe our learned members can shed some light on this ruling.

The merchant minister has admitted the firm belonged to him then but he had resigned from the firm when he was appointed "secretary of state".

Something told me yesterday that the Minister must be a lawyer working on behalf of a Client. Damage is done courtesy of Kenyan journalism
