Faulty Thermos flask:Help!

Yesterday(28/12/2011)I bought a thermos flask at Kamindi Supermarkets in Kiambu town only to discover it could not keep water hot through-out;as I found today morning ice-cold water in it!I decided to return it today(29/12/2011)only to be told that,"sorry,we cannot exchange it.After all you bought it at your own risk!" And just like that my money went down the drain! Dear Wazuans what options do I have?

Ati ulinunua flask wapi? There is a reason why the same flask will be a few shillings more expensive at Uchumi, Nakumatt, Chandarana et al. This is because the premium they charge includes some insurance for cases like yours. Buy consummables from backwater shops, durables from respected chains. All is not lost though, you can use the flask to store iced tea Happy holidays pal!!!

Was there a disclaimer somewhere, even on the shelves? If there isnt, zusha, demand to see the manager. That said, supermarkets, even megachains like nakumatt have their listing of non-returnable items.

I normally see people opening the cap and putting the flask to their ear to listen to the inside. I don't know what sound one is supposed to hear inside for a working flask. Weird! Does this test have any scientific basis?

@MISER you need to show them you know your rights, also as someone suggested don't buy such stuff from small-time supers like kamindi in Kiambu just go there for soap etc..that is however not an excuse to let them go,they should prove the it was not faulty when on their shelves as they did not offer a test to verify its functional status for a customer which is a standard procedure,if I were you I would go back there and make such a presentation that the manager or supervisor will be left with no option as to refund my money back....and it also sounds like the flask is still intact i.e it never fell or such, so demand for your rights as it appears the kamindi fellows think they can swindle the public..yet they were on TV the other day parading some women shoplifters who had stolen some foodstuffs and hidden them between their thighs,so if they are so morally upright let them refund your money...wana bahati sio mimi...I learnt the hard way how to deal with such unscrupulous retailers....
@QW25081985......FYI....Kila kitu ni china siku hizi and for the next God knows how many decades...the problem is some of our pea brained "businessmen" who go to China and import the cheapest stuff from the place...GOD knows for what reason coz it cant be profit margins...our KEBS is still asleep just like the the GoK and its 80% of its agencies so what to expect????
There is a brand of flasks called MEGA and sold by tuskys,they are made in China but under US patent and are some of the best....

Miser( ) Weka aibu kando, go there and zusha the most you can, insinuate that you may get violent. They will agree to exchange it with a similar one i.e same price ama uongezee chapa for a 'better brand'.
