My pal was terminated from her job four months ago and had an unsecured loan at stanchart.What is the worst case scenario? they keep calling her pressurizing her to 'look' for money to pay installments.No job prospects yet. I thought there is a sort of insurance one pays for this kind of scenario? anyone with experience or info.

Asi she is finished!!!!Pole to her.No insurance for Job loss in Kenya .


Please ask her to sell whatever she can and settle the loan before auctioneers come knocking .

That sofaset she bought at Ksh 50,000 will be valued at Ksh 500 by these ruthless auctioneers.
By selling before the auctioneers come , she can get better value .All the best .

How much is it? Has she notified the Bank that she lost her job and has no current job.

If amount is low, I don't see the Bank appointing Auctioneers.

Safe to put communication in writing.She can offer to pay once she gets a job.

Meanwhile, the worst I can forsee, is her being listed with the Credit Referencing Bureaus; meaning she is blacklisted and cannot get credit.

Auctioneers can come to you for any amount as long as they get a wind that you have some assets that are beyond the amount you owe.And they are stern , I tell you.

@Oaks, Thanks.. i thought the term unsecured meant that there are no assets that were offered as security? Se informed them that she is jobless. they mentioned credit reference blacklisting. The bad thing is that they are harrasing her as if she is jobless on purpose.

@Oaks is right, but @'user' must be the bank's official scarecrow.
If the lady took an unsecured facility, the bank cannot recover the money through liquidating any of her assets.
If the lady is willing to pay the loan, she should write and tell the bank; and keep them updated on her circumstances. She should also try to restructure the facility.

For the bank to attach her assets, it needs to convince a court that she is not insolent - a tall order.
These are not Kanu days for auctioneers to wreck havock without a court order. They would be dead if the lady knows her human rights. Or the bank can sue her - and since the law favors justice, not truth, she can convince the court that can only afford 1000 bob a month for say, a 2 million loan, the court has no qualms in ruling that she repays the money for the next 2000 months.

one pays 2% insurance fees while applying for the loan.

i think the worst case is bad ratings at CRB

Tell her to write to Stanchart informing them of her new situation.She should also propose a new repayment plan according to her present ability.That should be done immediately.
They cant legally touch you if you show willingness to pay having explained that you lost your job.

Failure to do the above,debt recovers will hound her and she will end up with her things auctioned.The loan is unsecured yes(when applying)....but you and your property are one thing when you default.
Formally employed people often live their employers' dream & forget about their own.

1000 a month for a 2M is a stretch. The installments have to be reasonable or the court wont accept that proposal. Being declared bankrupt would most likely be the end game in such a situation.

What then would have been the point of paying and installment?

The premium must be very high...perhaps as high as the loan itself! Unless the insurer was Blue Shield!

Note, the bank sues if it's economicaly viable. I.e you have the ability to pay, and the balance is significant enough to pay legal fees and it be left with something.. One thing you can rest assured, when u r listed by crb you r dead meat for the next seven years as u can't get credit: that which creates wealth.

Peole should go for bank loans only if the rate of return on the intended investment is higher than the interest on loan taken, unless what you desire is a necessary evil. Never go for a loan to buy 100k woth of sofaset. Save until you get the amount.

However, some employers have negotiated schemes such as Mortgage or car loan which offer far much lower interest rates than the market rates.

Now what is the different betyween secured and unsescured loan?
I think the employer is responsible for the unsecured loan since the payslip is attached to the loan.

the bank can't let you go with it as long as you are alive.rem,as much as it is unsecured you indicated where you stay in ua application form plus some referees,that what they use to trace you.if she had been given 8mths grace period after loosing her job then she is on a hot seat..if not careful she will burn her ...
