@mpenzi,please do not get there. To all of you guys,A writ of mandamus or mandamus (which means''we command ''in latin),or sometimes mandate is the name of one of the prerogative writs in common law,and is issued by a superior court to compel a lower court or a government officer to perform a mandate that is already theirs. I.e compelled to do what they are employed to do in the frist place. How this then relates to our current situation search me''.

MPs can actually vote and nulify an executive decission by a simply majority,those are standing orders. or they can pass another act outlawing the existing act.i.e they can pass a law outlawing the current one but with a specific proviso as to how the office holder is expected to carry out his duties

@ Mpenzi

If u remove letters 'p' and 'i' from your name and replace them with letters 'w' and 'a' respectively you will get a more familiar name. However,dont confuse 'silence' with 'lack of humiliation'.

@ Mr Tea...et all

this was never about mr ringera. please stop personalizing the issue. listening to the chairman of legal affair committee Mohamed Abdikadir this morning,he made it clear it was about the flawed procedure kibaki used-cunningly- just before recess to reappoint mr ringera. it's now up to the kacc advisory board to advertise for ringera's post and if he feels like re-applying,well,there's nothing to stop him. the board may or may not pick him. IT WAS ABOUT TAMING THE ROGUE EXECUTIVE. kacc chief investigator one dr mutonya was re-appointed by the board through proper procedures. when his tenure ended,the board advertised,he applied and beat off stiff competition to be the winner. his name was forward to kibaki and that's how he was picked. so why were the same methods not applied on ringera's case?

@Njung'e

All the more embarrassing!! I had so much hope in this dude i thought he would be just a little bit different! Naaah,not one bit... same coat circulating between him,thirikwa,gachara and kimondo!! I have realised he cant stand on his feet but has to hang on the uhurus et al.... mmmmh,it was a bad move supporting the 'evil alliances' of Ruto and Uhuru.... Of course he is being used and he will be dumped so quickly he wont know what hit him.

Be sure i will be on your campaign trail against him!!!

Experience is what you get when you don't get what you want.

There's no achievement there. What's the point of replacing the driver of a bus that has no engine and wheels.

Bright and interesting people talk about ideas.
Those of average intelligence talk about things.
Stupid people talk about other people.

@Mtalaam,
No driver has been replaced.If anything,parliamentarians are telling MK that he needs not a driver for a hopelessly dead bus.BTW,parliament has the capacity to dismantle that bus and sell it as scrap and buy a new one........did i hear you say Amen?.

@ Jaribu,
I have not the slightest clue as to how I have made this issue personal.Perhaps you could be so kind as to educate me how... People like you make the most sought after audience for the shenanigans when they stand up in public places and fora with their eloquent arguments designed to fool the informed and the educated. Look out for such deception. In the end,its just deceit whatever the appearance.

@Wote,i thought Mpenzi asked a valid question,cite the law that says parliament can annul in a BINDING form a gazette notice. It is laughable seeing Orengo quoted as citing section 85 of the constitution on powersto revoke executive orders as justification for this one.

All said and done I think Kibaki made his point,parliament has made its point,the court will make its point and as Kenyans we should celebrate that the three arms of government may actually be checking each other's powers and yet hakuna reli imengolewa. Believe you me parliament needs to be checked too for they were not baptised MPIGS in vain. And this demonising of MPs for voting like sambili did is a form of witch-hunting,that defeats the whole argument about democracy- would you rather MPs agreed all the time,like they did about their salaries and taxation? One thing is for sure,as long as Kibaki's MPs are outnumbered in parliament we will continue to have this kind of drama.

Mpenzi,if am not wrong,the board and parliament has 3 months within which to fill vacancy of director of KACC,so what happens when parliament is in recess for beyond the 3 months as they usually do from December?

@brewer surely if you ask me about the colour of a carpet and we are talking about forests would that be a valid question.

please see my reply below it clearly says standing orders that is what guides parliament and not laws.

Even Njung'e has put it better in simple and clear way.

@wote,
I am sure that must have been a slip of the tongue...Parliament like everyone else,is guided by the law and all laws of Kenya.Standing orders just guide debate and conduct of members inside the house.
