Wako should have known this. kenya should wait for September to come coz there will either be confirmation or rejection!!!

This isnt music to the ears of the suspects.

They now remain with one line of defence - the September hearings.

Unnerving indeed.

Does this not amount to self contradiction on the part of Judge Hans Kaul.
In his earlier ruling, he opined that the cases did not qualify to be taken by ICC.

Someone must have either convinced him or, the antics of the Gava made him change his mind. Whatever the case, I do not think it augurs well for the suspects.

Is this the end of setting up a local tribunal? Or are Kenyans going to wait to see the outcome of the rulings in September before they start demanding for a local tribunal considering their own political interest?

Talk of hanging oneself with ones tail, snippets of the submissions at the court:

Quote:
As such, "the rejection of the Special Tribunal, in the absence of other concrete and specific steps, is strongly indicative of an unwillingness to genuinely investigate and prosecute"

Thwack after thwack, on cheek after cheek is delivered to the government of kenya. Hell, the government of Kenya even thwacks itself like this:

Quote:
Moreover, even if the State possessed the same
evidence as that held by the Prosecutor, "there can be no requirement that in exclude ICC admissibility the State must conduct an investigation that leads to charging of those very individuals".

The judges take the cue of this thwackings and gives a helluva more thwackings e.g. with this opinion:

Quote:
In this respect, the Government seems to have understood, only in part, the test consistently applied by the Chambers of the Court in interpreting the scope of a "case" for the purposes of article 17 of the Statute.

And making reference to the other non-Kenyan cases complicates it for home boys.

Wazuans please read it, its only 29 pages long. Find out how incompetent the government of Kenya has been in applying logic.

The last remaining hope of escaping the court has been quenched, forever.

@Sanity, please usichoke. The golden rule when you find yourself in a hole is to stop digging... Aparently the O6 and the gava do not know this, so they have continued digging mpaka the sole dissenting judge now thinks they are comedians...

Laughing out loudly

Wako should read the judgment first before loosening his tongue. The government of Kenya has been shown to have tied and tripped itself up in more than one instance. If they want to go back for more drubbing....
