painting rental house before you vacate

I am planning to vacate the house i am living currently and am angered by the agent since he want to deduct 6,500sh from the deposit for painting. He will not allow me to paint myself and this amount was not indicated while moving in. The house is still clean. How fair is this?

Was it painted when you moved in? Is the ksh 6,500 fair value or usury? If he has offered to paint it, why bother with the headache of getting a painter, supervising, ensuring quality control and running the risk of having the agent reject the work as substandard?

It is a new one bedroom apartment i moved in 2009, the house is as clean as it was as i have seen with others who vacate he deducts the money but he does not paint and he will not allow you to pant yourself.

...should it not be the other way round where the owner of the house han an obligation to do some renovation at his/her cost after some time most always 5 years!!!!!

According to tenancy agreement if at all you signed one,you are expected to leave the house as you found it.In this case i assume it was painted.Its for the new tenant to ensure the house is painted otherwise if not he/she should not paint and both parties Agent/Tenant must agree on that.As of who is to paint both of you do a simple costing and agree otherwise 6500K is very fair.

I thought he should check whether umechafua ama hujachafua before he concludes how much you should pay if at all you should paint. Otherwise i want to be careful before moving to these upcoming new apartments coz they really try to make sure the deposit you made is retained.

@udaypette just let the agent deduct the money and move on. Refer to GG`s comment above which really captures it all.

Most tenancy agreement provide that you not only re-paint the house but also leave it in a state in which you found it. It is not uncommon for landlords to at times do all manner of `repairs` and deduct it from the deposit or even ask you to top it up.

those are the headaches associated with being a tenant..pls plan build your own hse as soon as possible to avoid future embarassments of that kind.

not every one can afford to build a house...
...besides, the presence of a safe alone does not signify that there is money inside...
