Hello wazuana,

It seems that Triza and the late Wanjiru were merely cohabiting with no iota of past traditional or legal marriage formalization process.

Do we have a provision in our laws dealing with cohabitation issues and the mandatory legal requirements for a cohabitation to be recognised as conventional marriage???

@ elder,

Are you telling me then that if i take a woman stay with her for one year or somewhere thereabout without any promise of marriage automatically makes her my wife? Don't think so.

@ simonkabz, carygoh,

If this is true our athletics hero was polygamous. 3 wives at least. 1 in nakuru, 2 in Nyahururu and others God knows where (may be japan).

On a lighter note going by this new katiba getting more wives might be easier than before.

of course - presumption of marriage. if the public around you takes you to be man and wife then the court will rule that you are. evidence in support of such presumption could include actual cohabitation, kids etc. but you can rebut the presumption with evidence showing otherwise.

i am sure of so many things though,

...that somebody lied to get wanjiru home in nyahururu...

...that there was a quarrel between two parties when the victim showed up...

...that after the quarrel somebody lay down dead...

...that whoever was taken to the mortuary was the home owner from eldoret...

...that coincidently the cctv system did not capture any image of the actions at the bedroom and the balcony where the death occured...

...that the above are not assumptions...
...besides, the presence of a safe alone does not signify that there is money inside...

@ Taz and Maichblack - totally agree with you.

They usually use to have their 'deal' in a lodging. BUT ON THIS DAY THEY WENT TO HIS HOUSE.
Wanjiru collected the barmaid at her place of work
and then they proceeded to Jimrock (not sure of the name of that bar ). And then they went to his house. Could it be that this time the barmaid insisted they
go to his house???????

And what was Triza not doin in her house at 11. Kwanza such a house????

And then when they got home....they went to watch T.V. C'mon........with a girl from a bar you go to bed straight. Thats the sole reason you brought her there. Infact knowing the wife can come anytime , they should have proceeded with their 'deal' haraka iwezekanavyo. Could it be that the barmaid insisted they first relax before they go to bed????? The way the barmaid explained how events took place since they arrived in wanjiru house to wanjiru's death sounds like a fake movie.

Competent investigators ought to establish the relationship between Triza and the barmaid ( Jane Nduta ).

They also need to check whether this two had been communicating prior to wanjiru's death.
