Hi all, whats the best legal way to get back, ones rent deposit? Is it through rent tribunal? Whats the procedure?

Honestly, i dont know but they do help. Plus most guys fear cops.

i thought rent tribunal only deals with small amounts, under 4k or so. sums larger than that, peleka court.

Most landlords don't refund the deposit. They will always look for excuses not to. One extreme will keep playing cat and mouse games with you till you give up while the other extreme will make deductions for "damages", repainting etc. mpaka it just about covers the deposit amount. This makes the theft of your deposit official - and final.

Best bet, where possible, is not to pay for the final month of your tenancy - let the deposit cover that - assuming you didn't sign an elaborate contract disallowing this and with fines for late/non payment of rent.

Rent tribunal is useless. Last time I heard, it was covering tenants paying monthly rent of 2,000/= and below. I don't know if this has been adjusted due to inflation.
Never count on making a good sale. Have the purchase price be so attractive that even a mediocre sale gives good returns.

yes, for residentials the tribunal will only consider your case if it is controlled ie with rents of less than ksh. 2500 per month. Ideally you should go to court and sue the landlord but the police do help.

You might end up paying more in legal costs while following up your deposit... why throw good money after bad(good) money?

Having said that, check if you have given notice notice according to lease agreement before you embark on legal procedure.

Otherwise, you can threaten to go with a few doors if he/she doesnt refund...

Did you get back your deposit?

I am in a similar situation. i have given one month's notice and my landlady wants me to pay the month for this month instead of me "sitting " on the deposit.

She says she will refund once the next tenant moves in and pays the deposit but she will have to deduct painting and damages charges.

i know from my neighbors experiences she is a difficult one when it comes to giving back deposits.
So if I don’t pay this months’ rent what’s the worst that can happen?

my landlord wants to run away with two months deposit. i got the incoming tenant to pay me one month rent but now he wants to evict her for that action! by the way, lease agreement, notice to vacate and everything was done as per procedure.. this landlord shall see the real me

Is the landlord fully KRA compliant? Tell him to refund the deposit within 7 days or else you will facilitate KRA to carry out a tax audit
