I had also heard of that angle of someone wanting to take over the business! I think had posted it in a thread here but as usual guys chose to play to the gallery. I think the guy my have been playing with some girls but that was not the real reason for his incarnation.

Well said. I think we will see more such rulings, as the upcoming vetting looms. Judges will have to deliver on payments soon. before they're out of a job.

Less emotion more fact...Evidence?? Example: You cannot claim you were raped when all doctors indicate you weren't...No evidence exists that the girls were minors...rape and/or sex with a minor is a serious crime in the sexual offences act. You need more than heresay to prosecute. I may not like the guy but the ruling is just, in Kenya or anywhere else. Interrogate the prosecutor...

@Ecstacy, I am happy there are people ready to look at facts and not focus on emotions. The appellate judge also avers that the girls were never examined for injuries etc to show that they were defiled.

I abhor sexual violence in any form, but I am also aware that there is no easier way to fix someone than to allege sexual impropriety. Emotions tend to boil over before evidence is examined.

Yerp. Rule of law and essence of evidence in it's application is primary. The rest is heresay & impunity.

@Robinhood & ecstacy: I applaud you guys for not dancing to the music!

Fact is, the prosecution were in a rush to throw this guy in jail for whatever reason. How would they present 25 witnesses and refuse to allow the defense to cross-examine them? On Wagner's first replying affidavit to the plaint, he requested scientific proof that the 'minors' were indeed minors! The prosecution alleged ati 'you don't need science to see that someone is a minor'!

I hope the new office of DPP will professionalise investigations so that we don't have this music of 'the judge was paid' etc!

@Sasha, a professional prosecution service is what is needed. They examine evidence and ensure that the real criminals get punishment befitting their crimes while the law abiding citizen is left free to do his thing. I am still angry at an instance a while back where a murder suspect (guy was suspected on killing his girlfriend)was set free over a technicality - ati because the police held him for more than 24 hours and therefore his constitutional rights were infringed. Absolute BS if you ask me. A well constituted prosecution service would ensure than such small print is taken care of and secure personal rights while punishing the guilty.
