"Kenya" to challenge ICC case..

T he Kenya government will challenge admissibility of Kenya case at the International Criminal Court.
"The government will challenge the admissibility of the cases as well as the jurisdiction of the court," said a statement by Attorney-General Amos Wako, Internal Security Minister Prof George Saitoti and Justice and Constitutional Affairs Minister Mutula Kilonzo.

So: "Article 17 of the Rome Statute says:
Having regard to paragraph 10 of the Preamble and article 1, the Court shall determine that a case is inadmissible where:
(a) The case is being investigated or prosecuted by a State which has jurisdiction over it, unless the State is unwilling or unable genuinely to carry out the investigation or prosecution;
(b) The case has been investigated by a State which has jurisdiction over it and the State has decided not to prosecute the person concerned, unless the decision resulted from the unwillingness or inability of the State genuinely to prosecute;
(c) The person concerned has already been tried for conduct which is the subject of the complaint, and a trial by the Court is not permitted under article 20, paragraph 3;
(d) The case is not of sufficient gravity to justify further action by the Court."So does anyone know on what grounds they will challenge the admissibility? In a place where thought is abandoned, freedom can become a curse.

So does anyone know on what grounds they will challenge the admissibility? (a) The case is being investigated or prosecuted by a State which has jurisdiction over it, unless the State is unwilling or unable genuinely to carry out the investigation or prosecution; 3 years later NO ONE has been found guilty an only one police officer was prosecuted and acquitted. Mr Ocampo twende Kazi. And let them not say "Kenya" will fight the ICC but rather, a cabal in the government will fight the ICC.

Kenya? Who are they representing? did they ask for our opinion?.... Well, i bet they wouldnt.....
May be it is just a few of us here who are for hague for these guys.... wazua should come up with that voting thing we had again we see if things have changed.....

Methinks Ocampo's in trouble!! Its him against the Govt of Kenya before the Judges!!!! Kenya is a Member nation of the ICC charter. How will the Judges handle this!! Isuni yilu yi maa me muyo - ni Mbisuu

Which govt of Kenya are we talking about here???.....the whole world know that Kenya has a coalition govt which is not speaking with one voice regarding the ICC, ....this notion that Ocampo is in trouble I really don't, he has nothing to lose really, after all his term is coming to an end and won't be renewed.
