"Following extensive consultations with a large section of Members of Parliament in order to ensure that national interest remains paramount, I reiterate that both the Legal and Justice Committee of Parliament as well as the Committee on Finance and Trade concluded that I have acted within my constitutional mandate in the execution of the nominations," he said at the Kenyatta International Conference Centre, Nairobi.

"However, considering the importance of the office of the Chief Justice as the head of the Judicial Arm of the Government, I have considered all the concerns expressed in regard to this nomination and I have concluded that it is beneficial that the nomination to fill this office, during the transition period, is also done through the Judicial Service Commission," said President Kibaki.

"In regard to nomination of the Attorney General, I have invited the Prime Minister for further consultations.

"I have also decided that the positions of Director of Public Prosecutions and Controller of Budget should be advertised through the Public Service Commission," he said.

President Kibaki said the move will "enable us to move forward with the implementation process of the Constitution"

Thought he was supposed to consult the PM.....

MCReggae, I will assume you are high on something. If I believed the constitution was followed and I backed it up with facts, does that make me a Kibaki psycophant? If I believe that its good for Kenyans that these positions will be advertised, does it make me want to be on winning side?? Boss, I dont want to lack respect for you. Wacha kunitafuta. Even now I will still insist the constitution was followed. I will not change that. And if you checked my posts, I was refering to the constitution as it is written.

However, if the powers that be decide that these positions have to be advertised, however consitutionally nominated they were IMHO, will I beat myself down as say "Oh Crapius!!!"? No. Like we said, there were 2 ways of nominations as addressed by the consitution.One was via consultations and the other was via JSC and PSC.

The reason I say Raila was the winner is because Kibaki made sure the announcement was made b4 Railas.If what kibaki was announcing was as a result of kenyan protest he would not have insisted on going to court on Monday.

I still believe Raila Had an arsenal he was going to use that made Kibaki make such a hasty retreat.

Raila did not win anything..he was exposed as self serving in not following the law himself in the recommendations Kibaki rejected...worse still he and his ODM brigade eg. Ababu Namwamba were forced to join other Kenyans like Mutula Kilonzo in thanking the President! LOL

Ironically, Kenya benefits not because of these two buggers..sorry Principals.. but because we have a new constitution whose violation has legal and political implications. The pressure from civil society & West, the leanings of the judiciary as well as popular public opinion have presented a cocktail that left no option to these two law breakers but to go back to the drawing board.
