Constitutional Court adjourns nominations case to 2nd March as ODM, others are enjoined......by this time, the CJ should have left office, are we going to see a vacuum here????

"The Attorney General who is representing the government in the case filed by civil society organisations has complicated the case somewhat, when he voiced an opinion that appeared to support the applicants' case.

The AG said the Judicial Service Commission should have been involved in the nomination of the next Chief Justice, and that gender balance ought to have been considered.

The government's chief legal advisor indicated to the court on Monday morning that his position was unlikely to change during the course of hearing."

Complicated? I think this should make it easy for the judges now.

What could be called an open and shut case.

@si_cheki_ovyo_ovyo - true. If the Court rules as expected, it does leave the Principals - who reportedly ignored relevant advise of their technical teams - with lots of egg over their faces.

On the bright side, is this a possible watershed in the nations history? Has the democratic space expanded with institutions checking excesses of the executive?
