there I will not lie......

just like a mechanic....

if you walk into his garage and go by what he quotes....

he will shaft you.....

it is not illegal...

in fact in law...

if I could charge 1 milli for an affidavit.....

you would not be able to sue me for 'overcharging'....

if I rate my drafting is worth that amount...

then that's what i will charge...

what i can not do is undercharge...

that's an offence.....

so before you part with your pounds......

consult......

how does undercharging become an offence?

what criteria do you use to determine a standard charge so as to know when undercharging?

the Law Society of Kenya ......

and other stakeholders convene.....

and deliberate......

on judicial procedure...... the standards of the profession.....

what is acceptable as a minimum..... and what is not....

regulation of the client... advocate relationship....

and regulation of advocate to advocate relationship....

so that i do not carry a loaded gun to court...

that is why...

advocacy....... in the legal sense......

is considered a profession........

as opposed to blogging....... tho' in some circles...... it's almost one .......

this is where the minimum standards are set...

and defined in law.....

so when....

TRS.........

breaks these regulations.......

the law defines that...

LSK....

can act to protect the public.....

and his colleagues.........wheter in court or in his chambers......

from his unprofessional ways.......

yes....

in the sense where......

'not liberalized' means 'not de-regulated'....

we are one of the most conservative professions.....

where we have rules against......

advertising.....

and that is the main reason why we set minimum charges.....

if we are to open up the profession...

eg US.....

we would not have to set minimum charges.......

the market demands are such that...

to swear an affidavit....

one would have to charge a minimum of 1500/- .....

to make any economic sense.....

et cetera....

sadly,...

we remain a profession....

that has standards set in such manner.....

as the clients....

or consumers of our products and services are not consulted......

i mean....

you are simply not 'learned' enough....

I do agree real shaft,in that case the guy got me,ought to have consulted but i knew no one hence someone took advantage. I aint complaining though,he got his cut well and good but now i know and everytime i come to kenya i'm very skeptical over so many things but thats life not every one makes a honesty buck

@Kamaa - when I first saw this post,more so the words 'affordable lawyer' - I indicated it is an oxymoron (like 'honest politician'....sorry TRS but I surmise that MOST lawyers have the same relationship that mara crossing wildebeest have with the crocodiles....taking advantage of others misfortunes smile

as I haven't had the chance to employ the services of a lawyer.......

try getting into the mode of asking legal advice ......

before action....

a service called 'preventive lawyering'......

moreorless......

looking before you leap........

which I do......

it saves you a bucket load of cash.......

analogy.....

if you have a small cavity...

a timely visit to the dentist will save you from much more than pain.....

a stitch in time saves you from TRS and his ilk......
