Gazette Notice on Mombasa Road Land Acquisition under Review

The Government is reviewing the land acquisition gazette notice in light of developments that have taken place along the road since the plans were initiated. The planned acquisition has been overtaken by events rendering some sections of the Gazette Notice obsolete.

Therefore, there should not be any panic because the Government does not intend to pull down some of the new developments on the highway.

What the Gazette Notice indicated was part of a 2006 plan for land acquisition on Mombasa road in preparation for the Nairobi Toll Road project. However, the project has been delayed due to protracted negotiations and since then new developments have taken place on the road. As it stands, acquisition of some of the sections would be too expensive to the Government and a huge burden to the tax payer.

The Government encourages Kenyans, and especially affected parties, not to read ill motive but to understand that the Government has to acquire land to enable it to develop vital infrastructure in our country.

A review of the acquisition notices is currently being undertaken by the concerned ministries and details will be made public in due course.

That is because we have only heard from those big owners. Almost everyone whose land touches Mombasa Rd or Waiyaki Way has been affected.

What I am trying to say is that there is a possibility that these lands were set apart a long time ago. That is why there was no development on that section for a very looong time. If you look at the houses that were built along the road in before 1990, you will realise that they are at least 50M from the road. Then there started coming buildings that even touch the road ( Hope they start demolishing at Capital Centre)

If you look at the Kencell building area, there is a huge space there left out for an intersection. Guys had even started fencing plots hapo.I think we have lazy lawyers who want to do conveyancing in the offices and bribe clerks at the lands ministry. I hope they have professional insurance coz singewasamehea.

Next time you drive down Msa road, keep the speed limit of 50Kph and observe. You will understand that most likely hizi ni ma deal za mabwenyenye that are turning back to haunt them.

These SMG fellows are just full of incitement.

Anyone shouting 'discrimination' does not understand compulsory acquisition or is just intent on inciting us against the gvt.

Sirikal has the right to take your land but it MUST provide for compensation which includes the market value of the land, cost of improvements and site works plus disturbance compensation at 15%.Dont forget this:THE GOVT ALWAYS PAYS!

The guys at SMG def know this but in their sensational style of (mis)informing the public they are linking it to the past raid and introducing politics.

This is not the fist time.We've had cases e.g the Kilifi Tiomin case where after politics was introduced guys were compensated with alternative land and paid for the fair value of the same land!

There's also the central police station staff quarters case.One arm of the govt constructed, the other brought the flats down.

However, I think the Ministries of Lands and Roads should come up with an integrated system as such disturbances are not good for business

According to them, the gov't should never build a road because they spent a lot of money. But it is ok when Nakumatt is removed because?
I read the paper online and I have to say, I now agree with those who claim that this company may have had a very huge hand in the developments of 2007.
Why didn't they just say, luo and Kalenjin ministers want their land?

Is it possible that this media company has been used before to fuel hatred and spread obvious propaganda and lies?

Compulsory acquisition is entrenched in Kenyan law and the constitution. It is not a new phenomenon. It is not unique to Kenya.

No wonder Kenya can never develop with these kind of Gobbels trained propaganda machines pretending to be newspapers.

This may not necessarily happen but the plot it stands on is affected by the gazette notice.
Facts as stated by Ministers:
1.The acquisition plan is an old one
2.When the plan was being conceptualized, many of the developments had not taken place
3.The cost of acquisition may necessarily influence the implementation of the plan hence the meeting called to take place in March for the affected persons to present their views
